COMMONWEALTH ELECTORAL ACT 1918 - SECT 384
Prosecution of offences(1) Subject to subsection (2), an offence against section 326 is an indictable offence.
(2) A court of summary jurisdiction may hear and determine proceedings in respect of the offence if the court is satisfied that it is proper to do so and the defendant and the prosecutor consent.
(3) If, under subsection (2), a court of summary
jurisdiction convicts a person of the offence, the court may impose a penalty
of imprisonment for a period not exceeding 12 months or a fine not exceeding
20 penalty units, or both.
