Schedule 2
3 Transitional provision
The exercise or purported exercise (whether before, at or after the commencement of this item) of the power under regulation 5 of the Air Navigation (Aviation Security Status Checking) Regulations 2004 to determine that a person has an adverse aviation security status is taken for all purposes to be, and is taken for all purposes always to have been, prescribed administrative action in respect of the person for the purposes of Part IV of the Australian Security Intelligence Organisation Act 1979.

Schedule 1
8 Application
An airside security zone established by a notice given under subsection 30(1) of the Aviation Transport Security Act 2004 before the commencement of item 7 of this Schedule is taken to have been in force from the time the notice was given.
12 Application
A landside security zone established by a notice given under subsection 32(1) of the Aviation Transport Security Act 2004 before the commencement of item 11 of this Schedule is taken to have been in force from the time the notice was given.
Schedule 2
34 Regulations
(1) The Governor‑General may make regulations prescribing matters:
(a) required or permitted by this Schedule to be prescribed; or
(b) necessary or convenient to be prescribed for carrying out or giving effect to this Schedule.
(2) In particular, regulations may be made:
(a) providing for regulations made for the purposes of particular provisions of the unamended Act to continue to have effect (with any prescribed alterations) for the purposes of the amended Act; and
(b) for other transitional measures in relation to the transition from the unamended Act to the amended Act.
(3) In this item:
amended Act means the Aviation Transport Security Act 2004 as in force immediately after the commencement of item 31 of this Schedule.
unamended Act means the Aviation Transport Security Act 2004 as in force immediately before the commencement of item 31 of this Schedule.

22 Application--transport security programs
(1) The amendment made by item 6 applies to transport security programs given under section 18 of the Aviation Transport Security Act 2004 after the commencement of that item.
(2) The amendment made by item 7 applies to transport security programs approved before or after the commencement of that item.

11 Saving and transitional provisions for multiple programs
Saving
(1) The Aviation Transport Security Act 2004, as in force at any time before the commencement of this Act, is taken not to have prevented more than one transport security program from being in force at the same time for an aviation industry participant, so long as those programs covered different operations or locations.
(2) However, if, because of the operation of subitem (1), there was more than one transport security program in force for an aviation industry participant at any time, the Aviation Transport Security Act 2004 is taken to have applied, in relation to each of those programs, as if it were the only program for the participant.
Transitional
(3) If, at the commencement of this Act, there is more than one transport security program in force for an aviation industry participant, then the Secretary is taken, at that time, to have given the participant a notice, under subsection 12(2) of the Aviation Transport Security Act 2004, that specifies the operation or location covered by each of those programs.

A delegation to an SES employee, or acting SES employee in force, immediately before the commencement of this item, under section 127 of the Aviation Transport Security Act 2004 (as in force immediately before the commencement of this item) has effect after that commencement as if it were a delegation to the SES employee, or the acting SES employee, under that section as amended by item 8 of this Schedule.
