"ACT law" means a law or provision that is, on Self-Government Day, converted
into an enactment by section 34 of the Self-Government Act.
"decision" means a decision under an ACT law.
- (2)
- Where, immediately before
Self-Government Day:
- (a)
- a person had a right to apply under the
Administrative Decisions (Judicial Review) Act 1977 for a review of a
decision; and
- (b)
- either:
- (i)
- the person had not made such an application;
or
- (ii)
- the person had made such an application and proceedings under that
Act arising from that right had not been finally disposed of;
then, on and
after that Day, the person continues to have that right as if the amendments
of that Act by this Act had not been made.
- (3)
- For the purposes of
subsection (2):
- (a)
- the decision shall be taken to have been made by
the person who would have made the decision under the ACT law as in force on
and after that Day; and
- (b)
- in any proceedings under that Act arising from
that right, the person referred to in paragraph (a) shall be substituted
as a party for the person who actually made the decision.
