AIR SERVICES ACT 1995 - SECT 55

             (1)  The Board's power to set service charges has effect subject to Part VIIA of the Trade Practices Act 1974 .

             (2)  If AA receives either of the following notices, AA must give the Minister a copy of the notice:

                     (a)  a notice under subsection 95L(3) of the Trade Practices Act 1974 about an inquiry into a supply of services that is the subject of a proposed determination of a service charge;

                     (b)  a notice under section 95ZJ of that Act withdrawing such a notice.

             (3)  If AA receives a report under section 95P of the Trade Practices Act 1974 on an inquiry held under that Act in relation to the supply of services by AA, it must give a copy of the report to the Minister.

             (4)  If AA has received a notice under subsection 95L(3) of the Trade Practices Act 1974 about an inquiry into the supply of services that is the subject of a proposed determination of a service charge, the period of 30 days referred to in subsection 54(2) does not begin until the Minister receives from AA:

                     (a)  a copy of a notice under paragraph (2)(b) of this section; or

                     (b)  a copy of the report under subsection (3) of this section in relation to the supply of services concerned.

             (5)  If the Minister receives from AA a copy of a report given to AA under section 95P of the Trade Practices Act 1974 in relation to the supply of services to which a proposed determination relates, the Minister may, in a notice under subsection 54(2), disapprove the proposed determination and substitute a fresh determination.

             (6)  The Minister's determination has effect as if it had been made by the Board under section 53.
