AGED OR DISABLED PERSONS CARE ACT 1954 - SECT 5
Delegation
- (1A)
- The Minister may, either generally or as otherwise provided by the
instrument of delegation, by writing signed by the Minister, delegate to the
Secretary, to an officer of the Department or to a person performing the
duties of an office in the Department all or any of the powers of the Minister
under this Act, other than this power of delegation.
- (1)
- The Secretary may,
either generally or as otherwise provided by the instrument of delegation, by
writing signed by the Secretary, delegate to an officer of the Department or
to a person performing the duties of an office in the Department all or any of
the powers of the Secretary under this Act, other than this power of
delegation.
- (2)
- A power so delegated, when exercised by the delegate, shall,
for the purposes of this Act, be deemed to have been exercised by the
Minister, or the Secretary, as the case requires.
- (3)
- A delegation under this
section does not prevent the exercise of a power by the Minister, or the
Secretary, as the case requires.
