(a)     Section 2 of the Air Navigation Act 1920 provides as follows:

                   2.   This Act shall commence in relation to the several States and Territories on such days as are respectively fixed by Proclamation.

         The respective dates so fixed were:

                              (a)   in relation to the then several States and Territories--28 March 1921 (see Gazette 1921, p. 480);

                              (b)   in relation to the Territory of Cocos (Keeling) Islands--23 November 1955 (see Gazette 1955, p. 3824A);

                              (c)   in relation to the Australian Antarctic Territory--19 April 1956 (see Gazette 1956, p. 1068); and

                              (d)   in relation to the Territory of Christmas Island--10 April 1959 (see Gazette 1959, p. 1149).

(b)    The Air Navigation Act 1920 was amended by Part LXXVII (section 280) only of the Statute Law (Miscellaneous Amendments) Act (No. 2) 1982, subsection 2(1) of which provides as follows:

                 (1)   Sections 1, 2, 166 and 195 and Parts III, VI, VII, XVI, XXXVI, XLIV, LI, LIII, LIV, LXI and LXXVII shall come into operation on the day on which this Act receives the Royal Assent.

(c)     The Air Navigation Act 1920 was amended by section 3 only of the Statute Law (Miscellaneous Provisions) Act (No. 1) 1983, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act shall come into operation on the twenty‑eighth day after the day on which it receives the Royal Assent.

(d)     The Civil Aviation Act 1988 was amended by section 8 only of the Transport Legislation Amendment Act 1989, subsection 2(3) of which provides as follows:

                 (3)   The amendments of the Civil Aviation Act 1988 made by this Act shall be taken to have commenced on 15 June 1988.

(e)     The Air Navigation Act 1920 was amended by Part 2 (sections 3-5) only of the Transport and Communications Legislation Amendment Act (No. 2) 1989, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

(f)      The Air Navigation Act 1920 was amended by subsection 4(1) only of the Transport and Communications Legislation Amendment Act 1990, subsections 2(1) and (2) of which provide as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

                 (2)   Subsection 4(1) is taken to have commenced at the same time Part IX of the Civil Aviation Act 1988 commenced.

(g)     The Air Navigation Act 1920 was amended by Part 2 (sections 3-6) only of the Transport and Communications Legislation Amendment Act (No. 2) 1992, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

(h)     The Air Navigation Act 1920 was amended by sections 3-15 only of the Transport and Communications Legislation Amendment Act 1992, subsections 2(1) and (3) of which provide as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

                 (3)   If the provisions mentioned in subsection (2) do not commence under that subsection within the period of 6 months beginning on the day on which this Act receives the Royal Assent, they commence on the first day after the end of that period.

(i)      The Air Navigation Act 1920 was amended by the Schedule (items 1-3) only of the Transport and Communications Legislation Amendment Act (No. 2) 1993, subsection 2(3) of which provides as follows:

                 (3)   The amendments contained in items 1, 2, 3, 20, 21, 22, 23 and 25 of the Schedule commence on a day to be fixed by Proclamation, being a day not before the day on which the Protocol inserting 83 bis into the Convention on International Civil Aviation comes into force in relation to Australia.

(j)      The Air Navigation Act 1920 was amended by subsection 3(1) only of the Transport and Communications Legislation Amendment Act 1994, subsection 2(1) of which provides as follows:

                 (1)   Subject to subsections (2) and (3), this Act commences on the day on which it receives the Royal Assent.

(k)     The Air Navigation Act 1920 was amended by section 3 only of the Qantas Sale Amendment Act 1994 subsection 2(1)of which provides as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

(l)      The Air Navigation Act 1920 was amended by section 5 only of the Civil Aviation Legislation Amendment Act 1995 , subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences on:

                              (a)   a day to be fixed by Proclamation; or

                              (b)   the first day after the end of the period of 6 months beginning on the day on which this Act receives the Royal Assent; whichever is earlier.

(m)    The Air Navigation Act 1920 was amended by Schedule (items 1-25) only of the Transport Legislation Amendment Act (No. 2) 1995, section 2 of which provides as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

                 (2)   The items in the Schedule (other than items 23 and 30) commence on a day or days to be fixed by Proclamation.

(n)     The Transport Legislation Amendment Act (No. 2) 1995 was amended by Schedule 3 (item 127) only of the Statute Law Revision Act 1996, subsection 2(3) of which provides as follows:

                 (3)   Each item in Schedule 3 is taken to have commenced when the Act containing the provision amended by the item received the Royal Assent.

(o)     The Air Navigation Act 1920 was amended by the Transport Legislation Amendment Act 1995, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

(p)     The Air Navigation Act 1920 was amended by Schedule 1 (Part A [items 1-4]) only of the Aviation Legislation Amendment Act (No. 1) 1998, subsections 2(1), (2) and (5) of which provide as follows:

                 (1)   Subject to subsections (2) and (3), Schedule 1 (other than items 9, 10 and 11) and Schedule 5 commence on a day or days to be fixed by Proclamation.

                 (2)   If an item of Schedule 1 does not commence under subsection (1) within 12 months after the day on which this Act receives the Royal Assent, the item commences on the first day after the end of that period.

                 (5)   The remaining provisions of this Act (including items 9, 10 and 11 of Schedule 1) commence on the day on which this Act receives the Royal Assent.

(q)     The Air Navigation Act 1920 was amended by Schedule 5 (item 1) only of the Corporate Law Economic Reform Program Act 1999, subsection 2(2)(b) of which provides as follows:

                 (2)   The following provisions commence on a day or days to be fixed by Proclamation:

                              (b)   the items in Schedules 1 to 7 (other than item 18 of Schedule 7);

(r)     The Air Navigation Act 1920 was amended by Schedule 1 only of the Aviation Legislation Amendment Act (No. 1) 2000, subsection 2(1) of which provides as follows:

                 (1)   Subject to subsection (2), this Act commences on the day on which it receives the Royal Assent.

(s)     The Air Navigation Act 1920 was amended by Schedule 3 (items 19-21) only of the Corporations (Repeals, Consequentials and Transitionals) Act 2001, subsection 2(3) of which provides as follows:

                 (3)   Subject to subsections (4) to (10), Schedule 3 commences, or is taken to have commenced, at the same time as the Corporations Act 2001.

(t)      Subsection 2(1) (item 4) of  of the Statute Law Revision Act 2002 provides as follows:

                 (1)   Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, on the day or at the time specified in column 2 of the table.

4  Application of Amendments

             (1)  Each amendment made by this Act applies to acts and omissions that take place after the amendment commences.

             (2)  For the purposes of this section, if an act or omission is alleged to have taken place between 2 dates, one before and one on or after the day on which a particular amendment commences, the act or omission is alleged to have taken place before the amendment commences.

Schedule 1

2  Transitional

Despite the repeal of Part 2A of the Air Navigation Act 1920, that Part continues to apply in relation to any investigation commenced under that Part before the repeal (including an investigation that had been completed).

 

Legislative Instruments (Transitional Provisions and Consequential Amendments) Act 2003 (No. 140, 2003)

4  Transitional provisions

             (1)  If legislation introduced into the Parliament before the commencing day but commencing on or after that day:

                     (a)  authorises an instrument to be made in the exercise of a power delegated by the Parliament; and

                     (b)  is expressed to require that instrument to be published as a statutory rule under the Statutory Rules Publication Act 1903;

any instrument so made is taken to be an instrument referred to in paragraph 6(b) of the Legislative Instruments Act 2003 despite the repeal by this Act of the Statutory Rules Publication Act 1903.

             (2)  If legislation introduced into the Parliament before the commencing day but commencing on or after that day:

                     (a)  authorises an instrument to be made in the exercise of a power delegated by the Parliament; and

                     (b)  is expressed to declare that instrument to be a disallowable instrument for the purposes of section 46A of the Acts Interpretation Act 1901;

any instrument so made is taken to be an instrument referred to in subparagraph 6(d)(i) of the Legislative Instruments Act 2003 despite the repeal by this Act of section 46A of the Acts Interpretation Act 1901.

             (3)  If legislation that is in force immediately before the commencing day or that is introduced into the Parliament before that day but that commences on or after that day:

                     (a)  authorised or authorises an instrument to be made in the exercise of a power delegated by the Parliament that adversely affects the rights of a person, or results in the imposition of liabilities on a person; and

                     (b)  provided or provides that the instrument has effect, to the extent that it adversely affects those rights or results in the imposition of those liabilities, despite subsection 48(2) of the Acts Interpretation Act 1901, before the date of its notification in the Gazette;

that legislation is to be construed, on and after the commencing day or the day of its commencement, whichever last occurs, as if it had provided instead that the instrument, to the extent that it adversely affects those rights or results in the imposition of those liabilities, has effect, despite subsection 12(2) of the Legislative Instruments Act 2003, before its registration under that Act.

             (4)  If:

                     (a)  legislation (the enabling legislation) in force immediately before the commencing day:

                              (i)  authorises the making of an instrument; and

                             (ii)  does not declare such an instrument to be a disallowable instrument for the purposes of section 46A of the Acts Interpretation Act 1901 but nonetheless makes provision for its disallowance by the application, with or without modification, of the provisions of Part XII of that Act; and

                     (b)  an instrument is made in the exercise of that authority on or after the commencing day; and

                     (c)  the instrument is not a legislative instrument for the purposes of the Legislative Instruments Act 2003 or otherwise;

the enabling legislation has effect, on and after the commencing day, as if:

                     (d)  it had declared such instruments to be disallowable instruments for the purposes of section 46B of the Acts Interpretation Act 1901; and

                     (e)  it had provided for such modifications of the operation of that section as are necessary to ensure that the effect of the applied provisions of Part XII of the Acts Interpretation Act 1901 is preserved.

             (5)  In this section:

commencing day means the commencing day within the meaning of the Legislative Instruments Act 2003.

 

Aviation Transport Security (Consequential Amendments and Transitional Provisions) Act 2004 (No. 9, 2004)

Schedule 3

1  Regulations

(1)        The Governor‑General may make regulations prescribing matters:

                     (a)  required or permitted by this Act to be prescribed; or

                     (b)  necessary or convenient to be prescribed for carrying out or giving effect to this Act.

(2)        In particular, regulations may be made:

                     (a)  providing for regulations made for the purposes of particular provisions of the old Act to continue to have effect (with any prescribed alterations) for the purposes of the new Act; and

                     (b)  providing for aviation security programs approved under the old Act to continue to be taken to be in force (with any prescribed alterations and for such time as is prescribed) as transport security programs under the new Act; and

                    (ba)  providing for airport security programs approved under the old Act to continue to be taken to be in force (with any prescribed alterations and for such time as is prescribed) as transport security programs under the new Act; and

                    (bb)  providing for ASIC programs and international cargo security programs approved under the old Act to continue to be taken to be in force (with any prescribed alterations and for such time as is prescribed) as transport security programs under the new Act, or as such other programs under the new Act as are prescribed by the regulations; and

                     (c)  for other transitional measures in relation to the transition from the old Act to the new Act.

(3)        In this item:

new Act means the Aviation Transport Security Act 2004.

old Act means the Air Navigation Act 1920 as in force immediately before the commencement of this item.

2  Aviation security program continuation

Subsection 15(2) (which deals with the obligation for aviation industry participants to comply with the transport security programs of other participants) of the Aviation Transport Security Act 2004 does not apply in relation to a program continued as a transport security program under paragraph 1(2)(b) of this Schedule.

3  Transitional provision

The exercise or purported exercise (whether before, at or after the commencement of this item) of the power under regulation 5 of the Air Navigation (Aviation Security Status Checking) Regulations 2004 to determine that a person has an adverse aviation security status is taken for all purposes to be, and is taken for all purposes always to have been, prescribed administrative action in respect of the person for the purposes of Part IV of the Australian Security Intelligence Organisation Act 1979.

 

Aviation Legislation Amendment (International Airline Licences and Carriers' Liability Insurance) Act 2008 (No. 87, 2008)

Schedule 1

26  Pre‑commencement licences

(1)        Despite the amendments made by this Schedule, the old law continues to apply in relation to the operation of a scheduled international air service in respect of which an international airline licence was in force immediately before the commencement time.

(2)        Subitem (1) has effect in relation to the operation of the service until whichever of the following first occurs:

                     (a)  the international airline licence is surrendered or cancelled in accordance with the old law as it continues to apply under subitem (1);

                     (b)  an international airline licence is granted, in respect of the operation of the service, under regulations made under the Air Navigation Act 1920 as in force at or after the commencement time;

                     (c)  the international airline licence is cancelled under subitem (3).

(3)        If the international airline licence is not surrendered or cancelled as mentioned in paragraph (2)(a) of this item, it is cancelled, by force of this subitem, when whichever of the following first occurs:

                     (a)  an international airline licence is granted in respect of the operation of the service as mentioned in paragraph (2)(b) of this item;

                     (b)  the period of 6 months beginning at the commencement time ends.

(4)        The Minister may, by legislative instrument, determine that the period mentioned in paragraph (3)(b) of this item is extended for a specified licence by the period, not exceeding 2 months, specified in the determination. The Minister cannot extend the period for a particular licence more than once.

(5)        A determination under subitem (4) has effect accordingly.

(6)        In this item:

commencement time means the time when this Schedule commences.

old law means:

                     (a)  an Act amended by this Schedule, as in force immediately before the commencement time; and

                     (b)  regulations, as in force from time to time, made under such an Act, as in force immediately before the commencement time.

27  Constitutional safety net--acquisition of property

(1)        If the operation of this Part would result in an acquisition of property from a person otherwise than on just terms, the Commonwealth is liable to pay a reasonable amount of compensation to the person.

(2)        If the Commonwealth and the person do not agree on the amount of the compensation, the person may institute proceedings in the Federal Court of Australia for the recovery from the Commonwealth of such reasonable amount of compensation as the court determines.

(3)        In this item:

acquisition of property has the same meaning as in paragraph 51(xxxi) of the Constitution.

just terms has the same meaning as in paragraph 51(xxxi) of the Constitution.
