AUSTRALIAN FILM, TELEVISION AND RADIO SCHOOL ACT 1973 - SECT 31

Acting Director

             (1)  The Governor‑General may appoint a person to act as the Director:

                     (a)  during a vacancy in the office of Director, whether or not an appointment has previously been made to the office; or

                     (b)  during any period, or during all periods, when the Director is, or is about to be, absent from duty or from Australia or, for any reason, unable to perform the functions of the Director's office.

             (2)  The Governor‑General may:

                     (a)  subject to this Act, on the recommendation of the Council, determine the terms and conditions of appointment of an Acting Director; and

                     (b)  at any time terminate such an appointment.

             (3)  Where a person is acting as the Director in accordance with paragraph (1)(b) and the office of Director becomes vacant while that person is so acting, that person may continue so to act until the Governor‑General otherwise directs or the vacancy is filled.

             (4)  The appointment of an Acting Director ceases to have effect if the Acting Director resigns the appointment by writing signed by the Acting Director and delivered to the Governor‑General.

             (5)  While the appointment of an Acting Director remains in force, the Acting Director has, and may exercise, all the powers and shall perform all the functions of the Director.

             (7)  Anything done by or in relation to a person purporting to act as the Director under subsection (1) is not invalid on the ground that:

                     (a)  the occasion for the person's appointment had not arisen;

                     (b)  there was a defect or irregularity in connection with the person's appointment;

                     (c)  the person's appointment had ceased to have effect; or

                     (d)  the occasion for the person to act had not arisen or had ceased.
