AUSTRALIAN CITIZENSHIP ACT 2007 - SECT 15
Citizenship by incorporation of Territory(1) A person is an Australian citizen if:
(a) any territory becomes a part of Australia; and
(b) the person is included in a class of persons specified in a determination under this section.
(2) The Minister may, by legislative instrument, determine that specified classes of persons are Australian citizens from a specified day because of their connection with that territory.
(3) The person becomes an Australian citizen on that day.
Retrospective application of instruments
(4) Subsection 12(2) (retrospective application of
legislative instruments) of the Legislation Act 2003 does not apply to the
instrument.
