(a) The Veterans' Affairs Legislation Amendment (Budget and Simplification Measures) Act 1997 was amended by Schedule 4 (items 1-4) only of the Aged Care Amendment (Omnibus) Act 1999, subsection 2(3) of which provides as follows:
(3) Schedule 4 is taken to have commenced immediately after the commencement of Schedule 2 to the Veterans' Affairs Legislation Amendment (Budget and Simplification Measures) Act 1997.
Schedule 2 commenced on 1 January 1998.
(b) The Aged Care Act 1997 was amended by Schedule 13 (items 1 and 2) only of the Social Security Legislation Amendment (Youth Allowance Consequential and Related Measures) Act 1998, subsection 2(1) of which provides as follows:
(1) Subject to subsections (2) to (10), this Act commences on 1 July 1998.
(c) The Aged Care Act 1997 was amended by Schedule 1 (items 1-49) only of the Aged Care Amendment (Omnibus) Act 1999, subsection 2(1) of which provides as follows:
(1) Subject to this section, this Act commences on a day to be fixed by Proclamation.
(d) The Aged Care Act 1997 was amended by Schedule 1 (item 56) only of the Public Employment (Consequential and Transitional) Amendment Act 1999, subsections 2(1) and (2) of which provide as follows:
(1) In this Act, commencing time means the time when the Public Service Act 1999 commences.
(2) Subject to this section, this Act commences at the commencing time.
(e) Subsection 2(1) (item 3) of the Statute Law Revision Act 2002 provides as follows:
(1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, on the day or at the time specified in column 2 of the table.

418 Transitional--pre‑commencement offences
(1) Despite the amendment or repeal of a provision by this Schedule, that provision continues to apply, after the commencement of this item, in relation to:
(a) an offence committed before the commencement of this item; or
(b) proceedings for an offence alleged to have been committed before the commencement of this item; or
(c) any matter connected with, or arising out of, such proceedings;
as if the amendment or repeal had not been made.
(2) Subitem (1) does not limit the operation of section 8 of the Acts Interpretation Act 1901.
419 Transitional--pre‑commencement notices
If:
(a) a provision in force immediately before the commencement of this item required that a notice set out the effect of one or more other provisions; and
(b) any or all of those other provisions are repealed by this Schedule; and
(c) the first‑mentioned provision is amended by this Schedule;
the amendment of the first‑mentioned provision by this Schedule does not affect the validity of such a notice that was given before the commencement of this item.

10 Application of amendments--Part 4.4 of the Aged Care Act 1997
The amendments of Part 4.4 of the Aged Care Act 1997 made by this Schedule apply to a sanction if a notice imposing the sanction is given under section 67‑5 of the Aged Care Act 1997 after the commencement of this item.

(1) Each amendment made by this Act applies to acts and omissions that take place after the amendment commences.
(2) For the purposes of this section, if an act or omission is alleged to have taken place between 2 dates, one before and one on or after the day on which a particular amendment commences, the act or omission is alleged to have taken place before the amendment commences.

Schedule 2
27 Application of amendments
Entry and approval on or after 1 July 2005
(1) The amendments made by this Schedule apply in relation to the entry of a person into a residential care service (whether for the first time or not) if:
(a) the entry occurs on or after 1 July 2005; and
(b) the person is approved under section 22‑1 of the Aged Care Act 1997 on or after 1 July 2005 as a recipient of residential care.
Entry on or after 1 July 2005, approval before 1 July 2005
(2) The amendments also apply in relation to the entry of a person into a residential care service (whether for the first time or not) if:
(a) the entry occurs on or after 1 July 2005; and
(b) the person was approved under section 22‑1 of the Aged Care Act 1997 before 1 July 2005 as a recipient of residential care; and
(c) the approval had not expired, lapsed or been revoked under Division 23 of that Act by the time of the entry; and
(d) the person chooses that the amendments apply.
(3) The person is taken to have made such a choice if he or she has applied in the approved form for the Secretary to determine the value of the person's assets at a time that is before or at the time of entry. This does not limit the ways in which the person may make such a choice.
Exception to application--re‑entry into care within 28 days
(4) Despite subitems (1) and (2), the amendments do not apply in relation to the person entering the residential care service (the new service) if:
(a) the entry occurs within 28 days after the person was last provided with residential care (other than respite care) through a residential care service (the earlier service) and the person had paid an accommodation bond for entry to the earlier service; and
(b) the amendments did not apply in relation to the person's most recent earlier entry into the earlier service; and
(c) it is not the case that:
(i) the person was provided with a low level of residential care through the earlier service; and
(ii) the person is provided with a high level of residential care through the new service.
Note: If the amendments do not apply, then the Aged Care Act 1997 as in force without the amendments applies to the person.
Aged Care Amendment (Extra Service) Act 2005 (No. 59, 2005)
Schedule 1
11 Transitional
(1) This item applies to a place included in a residential care service, or a distinct part of a residential care service, for which a determination was in force under section 31‑2 of the Aged Care Act 1997 immediately before 1 July 2005.
(2) The place continues to be an extra service place for the care recipient for whom residential care was being provided, in respect of that place, on an extra service basis immediately before that day during the period:
(a) starting on that day; and
(b) ending at the end of the last day on which the care recipient is provided with residential care in respect of the place.

1 Regulations
(1) The Governor‑General may make regulations prescribing matters:
(a) required or permitted by this Act to be prescribed; or
(b) necessary or convenient to be prescribed for carrying out or giving effect to this Act.
(2) In particular, regulations may be made prescribing matters of a transitional nature (including prescribing any saving or application provisions) relating to the amendments or repeals made by this Act.
Aged Care Amendment (Residential Care) Act 2006 (No. 133, 2006)

2 Application of subsections 44‑10(1A), (1B) and (1C)--working out the value of assets on or after 1 January 2007 for people entering an aged care service after that date
Subsections 44‑10(1A), (1B) and (1C) of the Aged Care Act 1997 apply to the working out of the value of a person's assets if:
(a) the working out is done on or after 1 January 2007; and
(b) the person enters an aged care service (within the meaning of that Act) on or after that date.
3 Application of subsection 44‑10(1C)--assets disposed of on or after 10 May 2006
(1) In determining an amount under paragraph 44‑10(1C)(a) of the Aged Care Act 1997, the Secretary must take into account assets that a person disposes of (within the meaning of Subdivision B of Division 11 of Part IIIB of the Veterans' Entitlements Act 1986) on or after 10 May 2006.
(2) In determining an amount under paragraph 44‑10(1C)(b) of the Aged Care Act 1997, the Secretary must take into account assets that a person disposes of (within the meaning of Division 2 of Part 3.12 of the Social Security Act 1991) on or after 10 May 2006.
Schedule 2
2 Application of amendment of subsection 96‑2(5)
Despite the repeal and substitution of subsection 96‑2(5) of the Aged Care Act 1997 by this Schedule, delegations in force under that subsection immediately before the commencement of this Schedule continue to have effect on and from the commencement of this Schedule as if they had been made under paragraph 96‑2(5)(a) of that Act as in force immediately after the commencement of this Schedule.
Australian Participants in British Nuclear Tests (Treatment) (Consequential Amendments and Transitional Provisions) Act 2006 (No. 136, 2006)
Schedule 2
1 Claims made on or after 19 June 2006--eligibility to be provided with treatment
(1) If:
(a) a person made a claim on or after 19 June 2006 but before the commencement of the Australian Participants in British Nuclear Tests (Treatment) Act 2006; and
(b) had the claim been made after that commencement, it would have been a claim made, in accordance with section 6 of that Act, for a determination that he or she is an eligible person (within the meaning of that Act);
the claim is taken, for the purposes of that Act, to be a claim made under section 8 of that Act for such a determination.
(2) The Commission may, under section 13 of that Act, approve the provision of treatment that was provided before the claim was made, but must not approve the provision of treatment that was provided before 19 June 2006.
2 Claims made on or after 19 June 2006--entitlement to travelling expenses
(1) If:
(a) a person made a claim on or after 19 June 2006 but before the commencement of the Australian Participants in British Nuclear Tests (Treatment) Act 2006; and
(b) had the claim been made after that commencement, it would have been a claim made, in accordance with section 6 of that Act, for a determination that he or she is entitled to be paid travelling expenses under Part 3 of that Act;
the claim is taken, for the purposes of that Act, to be a claim made under section 21 of that Act for such a determination.
(2) The person can, under Part 3 of that Act, be entitled to be paid travelling expenses in connection with travel that occurred before the claim was made, but not in connection with travel that occurred before 19 June 2006.

The amendments made by this Schedule apply in relation to reportable assaults first alleged or suspected on or after the commencement of this Schedule to have occurred before, on or after that commencement.

49 Interpretation
Expressions used in this Part that are defined in the Aged Care Act 1997 have the same meaning in this Part as they have in that Act.
50 Approval of persons as care recipients
Application
(1) Subsection 22‑2(3) of the Aged Care Act 1997, as in force after the commencement of this Schedule, applies in relation to approvals made on or after the commencement of this Schedule.
(2) Paragraph 22‑6(2)(c) of the Aged Care Act 1997, as in force after the commencement of this Schedule, applies in relation to notices under subsection 22‑6(1) of that Act that relate to approvals made on or after the commencement of this Schedule.
Saving
(3) If, immediately before the commencement of this Schedule, a person's approval was limited under subsection 22‑2(3) of the Aged Care Act 1997 to one or more levels of care corresponding to the classification levels, then, on and after the commencement of this Schedule, the person's approval is taken to be limited under that subsection as in force after the commencement of this Schedule to a low level of residential care.
51 Classification of care recipients
(1) This item applies to a care recipient:
(a) to whom an approved provider begins providing care before the commencement of this Schedule; and
(b) whose approval is limited under subsection 22‑2(3) of the Aged Care Act 1997 to a low level of residential care; and
(c) who was not classified under subsection 25‑1(1) of that Act before the commencement of this Schedule.
(2) The Secretary must not, on or after the commencement of this Schedule, classify the care recipient under subsection 25‑1(1) of the Aged Care Act 1997 to a level of care exceeding a low level of residential care.
52 Appraisals of level of care needed by care recipients
Application
(1) Subsections 25‑3(2), (2A) and (3A) of the Aged Care Act 1997, as in force after the commencement of this Schedule, apply in relation to an appraisal of a care recipient to whom an approved provider begins providing care on or after the commencement of this Schedule.
Saving
(2) Despite the repeal and substitution of subsection 25‑3(2) of the Aged Care Act 1997 made by this Schedule, if a care recipient to whom an approved provider began providing care before the commencement of this Schedule had not been appraised before that commencement, Classification Principles in force immediately before the commencement of this Schedule and made for the purposes of that subsection continue to have effect in relation to the care recipient's appraisal.
Transitional
(3) Paragraph 26‑1(b) of the Aged Care Act 1997, as in force after the commencement of this Schedule, applies in relation to a care recipient to whom an approved provider begins providing care during the period of one month beginning on the commencement of this Schedule as if the period of 2 months specified in that paragraph were extended to 3 months.
53 Suspension of approved providers from making appraisals and reappraisals
Subsections 25‑4(1) to (3) of the Aged Care Act 1997, as in force after the commencement of this Schedule, apply in relation to an approved provider to whom a notice under subsection 25‑4(3) of that Act is given on or after the commencement of this Schedule.
54 Reappraisals of level of care needed by care recipients
Application
(1) This item applies in relation to a care recipient in respect of whom an appraisal was made under section 25‑3, or a reappraisal was made under section 28‑2, of the Aged Care Act 1997 as in force immediately before the commencement of this Schedule.
(2) Subject to the modifications set out in subitems (3), (4) and (5), Divisions 27 and 28 of the Aged Care Act 1997, as in force immediately before the commencement of this Schedule, and Classification Principles made for the purposes of those Divisions, continue to apply in relation to the care recipient until the care recipient's classification is renewed under Division 28 of that Act as it applies because of this subitem.
(3) The following provisions of the Aged Care Act 1997, as in force after the commencement of this Schedule, and Classification Principles made for the purposes of those provisions, apply from that commencement in relation to the care recipient:
(a) section 27‑3 (reappraisal required by Secretary);
(b) Division 27, to the extent to which it applies to notices given under section 27‑3;
(c) section 27‑5 (requirements for reappraisals), instead of repealed subsections 28‑2(1) to (3) and Classification Principles made for the purposes of those repealed subsections;
(d) subsections 27‑6(2) and (3) (renewal of classifications), instead of repealed subsections 28‑1(2) and (3) and Classification Principles made for the purposes of those repealed subsections.
Extended reappraisal period for classifications
(4) Paragraph 28‑3(1)(a) of the Aged Care Act 1997, as it applies because of subitem (2), applies in relation to a classification whose expiry date occurs during the period of one month beginning on the commencement of this Schedule, as if the period mentioned in that paragraph ended 2 months after the expiry date of the classification.
(5) Subsection 28‑3(2) of the Aged Care Act 1997, as it applies because of subitem (2), applies in relation to a classification of a care recipient to whom the provision of residential care recommences during the period of one month beginning on the commencement of this Schedule, as if the reappraisal period specified in that subsection were the period of 3 months beginning on the day on which the provision of residential care to the care recipient through the residential care service recommenced.
55 Eligibility for residential care subsidy
Sections 42‑1 and 42‑2 of the Aged Care Act 1997, as in force immediately before the commencement of this Schedule, continue to have effect after the commencement of this Schedule, in relation to a care recipient who was covered by subsection 42‑1(4) immediately before the commencement of this Schedule, until the end of the period of leave mentioned in that subsection.
56 Effect of long periods in hospital on basic subsidy amount
Sections 44‑4 and 44‑6 of the Aged Care Act 1997, as in force immediately before the commencement of this Schedule, continue to have effect after the commencement of this Schedule, in relation to a care recipient who was covered by paragraph 44‑4(1)(a) immediately before the commencement of this Schedule, until the end of the period of leave mentioned in that paragraph.

(i) the last residential care service through which residential care was provided, or taken to be provided, to the care recipient before 20 March 2008 and the next residential care service through which residential care is provided, or taken to be provided, to the care recipient; and
(ii) any residential care service through which residential care is provided, or taken to be provided, to the care recipient on or after 20 March 2008 and the next residential care service through which residential care is provided, or taken to be provided, to the care recipient.
181 Application of item 124
The amendment made by item 124 of this Schedule applies in relation to residential care grants allocated on or after 20 March 2008.
182 Application of items 127 and 128
The amendments made by items 127 and 128 of this Schedule apply in relation to community care grants allocated on or after 20 March 2008.
183 Application of items 132, 135, 137 and 139 to 146
The amendments made by items 132, 135, 137 and 139 to 146 of this Schedule apply in relation to decisions in relation to the determination of matters under section 44‑24 of the Aged Care Act 1997 for the purposes of calculating the daily income tested reduction for a day that falls on or after 20 March 2008.
184 Application of items 153 and 154
The amendments made by items 153 and 154 of this Schedule apply in relation to the determination of matters under section 44‑24 of the Aged Care Act 1997 for the purposes of calculating the daily income tested reduction for a day that falls on or after 20 March 2008.
185 Transitional provision
(1) This item applies to claims for subsidy made under section 43‑4 before 20 March 2008.
(2) Section 43‑4A (as inserted by item 21 of this Schedule) applies to those claims as if the reference in paragraph 43‑4A(1)(a) of the Aged Care Act 1997 to the end of the payment period were a reference to 20 March 2008.
186 Transitional provision
(1) This item applies to claims for subsidy made under section 47‑4 before 20 March 2008.
(2) Section 47‑4A of the Aged Care Act 1997 (as inserted by item 93 of this Schedule) applies to those claims as if the reference in paragraph 47‑4A(1)(a) of that Act to the end of the payment period were a reference to 20 March 2008.

185 Interpretation
(1) In this Part:
commencing day means 1 January 2009.
transition day means the day immediately after the end of the transition period.
transition period means a period of 6 months beginning at the start of the commencing day.
(2) Subject to subitem (1), an expression used in this Part that is also used in the Aged Care Act 1997 has the same meaning in this Part as it has in that Act.
186 Application of amendments to existing approved providers
(1) If, immediately before the commencing day, a person is an approved provider, the approved provider amendments do not apply in relation to the person during the transition period.
(2) On the transition day, the approval of the person is taken to be in respect of:
