EXPLANATORY MEMORANDUM
(Amendments to be moved on behalf of the

These amendments alter clauses 6, 75, 112 and 186 of the Bill. The
amendments provide that the form of declaration envelopes used in ballots
conducted by the Australian Electoral Commission is to be prescribed by the
regulations. The amended clauses relate to ballots for elections, amalgamations
and withdrawal from amalgamations.
The proposed amendments are not expected to have any impact on
Commonwealth expenditure.
NOTES ON AMENDMENTS
Amendment No. 1 would change the definition of declaration envelope by
omitting the words “The regulations must prescribe the form of a
declaration envelope”.
Amendment No. 2 would replace the words “approved form” in clause
75 with the words “form prescribed by the regulations”.
Amendment No. 3 would replace the words “approved form” in clause 112 with the words “form prescribed by the regulations”.
Amendment No. 4 would replace the words “approved form” in clause 186 with the words “form prescribed by the regulations”.
Amendment No. 5 would amend clause 186 to remove the words “and approved” from the note to clause 186. This is consistent with amendment No 4 which removes the words “approved form”.
