PRIMARY INDUSTRIES (EXCISE) LEVIES AMENDMENT BILL
2000
GENERAL OUTLINE
The purpose of the
Primary Industries (Excise) Levies Amendment Bill 2000 is to repeal clause 7 of
Schedule 18 to the Primary Industries (Excise) Levies Act 1999. Clause 7
(the sunset clause) provides for the cessation of the Schedule 18 at the end of
30 June 2000.
Schedule 18 to the Primary Industries (Excise) Levies
Act 1999 provides for the imposition of levy on transactions involving
sheep, lambs and goats. The levy raises around $16 million per annum. Funds
raised by the levy are used to meet the industry's commitments to marketing and
promotion, research and development, and animal health.
In the absence of
an amendment to or repeal of the sunset clause, there will be no statutory basis
by which levies can be raised and then disbursed from consolidated revenue to
marketing and promotion, research and development, and animal health purposes
for the benefit of the sheep, lamb and goat industries.
Parliament
amended the Livestock Transactions Levy Bill 1997 to introduce the sunset
clause. The objective in adding the sunset clause was to review the
effectiveness of the levy mechanism over a defined period of time. The
Live-stock Transactions Levy Act 1997 was repealed by the Primary
Industries Levies and Charges (Consequential Amendments) Act 1999 but
replaced, in effect, by Schedule 18 to the Primary Industries (Excise) Levies
Act 1999 as part of a wider portfolio levies and charges legislation
rationalisation exercise.
FINANCIAL IMPACT
STATEMENT
The proposed levy will have no financial implications
for the Commonwealth. The Sheepmeat Council of Australia recommended in a
report to the Minister for Agriculture, Fisheries and Forestry that the sunset
clause should be repealed in order to provide for the continuation of the levy
arrangements in respect of sheep, lambs and goats. The Sheepmeat Council of
Australia's report to the Minister was made after extensive consultation with
relevant industry sectors.
NOTES ON
CLAUSES
Clause 1: Short title
This clause
provides that the Act may be cited as the Primary Industries (Excise) Levies
Amendment Act 2000.
Clause 2: Commencement
This
clause provides for the commencement of the Act to be 30 June
2000.
Clause 3: Interpretation
This clause provides that
the Act specified in the Schedule is amended as set out in the
Schedule.
Schedule 1: Amendments
Schedule 1 contains one
clause. That clause provides for the repeal of clause 7 of Schedule 18 to the
Primary Industries (Excise) Levies Act 1999.
