The Parliament of Australia enacts:
4
1 Short title
5
This Act may be cited as the Unit Pricing (Easy comparison of
6
grocery prices) Act 2008.

2 Commence ment
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

The object of this Act is to require retailers selling grocery
14
products to display unit prices for grocery products sold by
15
measure, weight or volume.

(1) Subject to subsection (2), this Act and the regulations are intended

to apply to the exclusion of any State or Territory law to the extent

that the State or Territory law relates to unit pricing of grocery
12
products sold by measure, weight or volume.

Exception--certain State and Territory laws coexist with
14
Commonwealth law
15
(2) This Act and the regulations are not intended to exclude or limit
16
the concurrent operation of any State or Territory law relating to
17
improper practices in connection with unit pricing of grocery
18
products sold by measure, weight or volume.

(1) This Part applies to grocery products sold by retailers by
27
measure, weight or volume.

(2) Division 2 sets out the requirements that apply to retailers in

relation to unit pricing of grocery products and provides for

pricing of grocery products.

(4) Division 4 sets out provisions relating to unit pricing
6
inspectors.

(5) Division 5 sets out the additional functions of the Secretary in

relation to this Part.

18ZZH Interpretation
10
In this Part, unless the contrary intention appears:
11
advertisement means any form of advertisement which is made in
12
order to promote the sale of a grocery product, including sale by
13
distance contract, and includes an advertisement or product
14
catalogue on the Internet, but does not include a container or a
15
label.
16
consumer means a natural person who buys a grocery product for
17
purposes that do not fall within the sphere of his or her commercial
18
or professional activity.
19
cosmetic products means any substance or preparation intended to
20
be placed in contact with an external part of the human body, or
21
with the teeth, the inside of the mouth or throat with a view
22
exclusively or mainly to one or more of the following purposes:
23
cleaning, perfuming, changing the appearance of, protecting, and
24
keeping in good condition the body, or correcting body odour.
25
distance contract means any contract for the sale of a grocery
26
product entered into by a retailer and a consumer by any means, or
27
in any manner, without those persons being simultaneously present
28
together.
29
grocery products are products sold by any retail grocery store and
30
include but are not limited to staple foods such as meats, fruit and
31
vegetable produce, baked goods and dairy products, canned and
32
packaged goods, snacks and confectionary, non-alcoholic

beverages, household goods (tissues, paper towels, food wraps, bin
1
liners, light bulbs, batteries, and similar products), pharmaceutical
2
products, cosmetic products, make-up products, toiletries, baby
3
supplies such as nappies, haberdashery, tobacco and tobacco
4
products, household cleaning products, pet supplies and other
5
household supplies, and alcoholic beverages when such beverages
6
are sold by a retailer of grocery products but exclude clothing,
7
newspapers, magazines, greetings cards, compact discs, video and
8
audio tapes, toys, plants, flowers, electrical appliances, kitchen
9
hardware, gardening equipment and books and grocery product
10
means any one of them.
11
grocery products sold in bulk means grocery products which are
12
not pre-packaged and are weighed or measured at the request of the
13
consumer and in the presence of the consumer.
14
infringement notice means an infringement notice under
15
section 18ZZN.
16
itinerant retailer means any retailer who, as a pedestrian, or from a
17
train, aircraft, vehicle, vessel, stall, barrow or other mobile sales
18
unit, offers directly to a consumer grocery products other than by
19
means of pre-printed material.
20
liquid medium means the following products, including in
21
mixtures and also frozen or quick-frozen, provided that the liquid
22
is merely an adjunct to the essential elements of a grocery product
23
and is therefore not a decisive factor for the purchase of the
24
grocery product: water, salt water, brine, vinegar, aqueous
25
solutions of salts, food acids, sugars, or other sweetening
26
substances, and fruit or vegetable juices in the case of tinned fruit
27
or vegetables.
28
make-up products means cosmetic products solely intended
29
temporarily to change the appearance of the face or nails, including
30
(but not limited to) lipsticks, mascaras, eye shadows, blushers and
31
concealers.
32
net drained weight means the weight of a solid food grocery
33
product when it is presented in a liquid medium, excluding any
34
materials, substances or items not considered to be part of the
35
grocery product.

online retailer means any individual who or body corporate that

sells or offers or exposes for sale over the Internet grocery products
2
which fall within the sphere of the online retailer's commercial or
3
professional activity.

premises includes any building, shop, store, dwelling, kiosk,
5
temporary construction, or an area in any of the foregoing in which
6
trading is carried on pursuant to a franchise or concession.
7
primary indication of quantity means one kilogram, one litre, one
8
metre, one square metre or one cubic metre of a grocery product.
9
relevant floor area in relation to a shop means the internal floor
10
area of the shop excluding any area not used for the retail sale of
11
grocery products or for the display of such products for retail sale.
12
retailer means any individual who or body corporate that sells or
13
offers or exposes for sale directly to a consumer grocery products
14
which fall within the sphere of the retailer's commercial or
15
professional activity, and includes an online retailer.
16
selling price means the final price, including GST and all other
17
taxes, for a unit of a grocery product, or a given quantity of a
18
grocery product.
19
shop includes:
20
(a) a store, kiosk and a franchise or concession within a shop;
21
and
22
(b) in the case of an online retailer-- an online shop, e-shop,
23
e-store, Internet shop, web shop, online store, or virtual store.
24
single premises shop means the shop of a retailer that operates
25
from only that unique location and which has a relevant floor area
26
not exceeding 200 square metres.
27
supplementary indication of quantity means an indication of
28
quantity that is not a primary indication of quantity of a grocery
29
product, and which can be a lesser or a greater quantity than the
30
relevant primary indication of quantity of a grocery product.
31
unit price means the final price, including GST and all other taxes,
32
for one kilogram, one litre, one metre, one square metre or one
33
cubic metre of a grocery product except in respect of grocery
34
products sold by number, where unit price means the final price
35

including GST and all other taxes for an individual item of the

grocery product.

Division 2--Requirements for retailers
3
18ZZI Requirement to provide information about unit pricing
4
(1) A retailer must prominently display in the retailer's premises or in
5
each of the retailer's premises posters and pamphlets for the use of
6
consumers or prospective consumers, containing information about
7
unit pricing and how it can used by consumers.
8
(2) A retailer must ensure that the posters and pamphlets required
9
under subsection (1) are:
10
(a) unambiguous and easily identifiable; and
11
(b) clearly visible and legible to consumers and prospective
12
consumers; and
13
(c) placed at multiple locations throughout the retailer's
14
premises.
15
(3) A retailer must not contravene this section.
16
Civil penalty:
17
(a) for an individual:
18
(i) in the case of a first or second offence--10 penalty units
19
or such lower amount as is prescribed by the
20
regulations;
21
(ii) in the case of a third or subsequent offence--100
22
penalty units or such lower amount as is prescribed by
23
the regulations;
24
(b) for a body corporate:
25
(i) in the case of a first or second offence--100 penalty
26
units or such lower amount as is prescribed by the
27
regulations;
28
(ii) in the case of a third or subsequent offence--1,000
29
penalty units or such lower amount as is prescribed by
30
the regulations.

18ZZJ Require ment to indicate selling price
1
(1) Subject to subsection (2), if a retailer indicates that a grocery
2
product is or may be for sale to a consumer, the retailer must
3
indicate the selling price of that grocery product in accordance with
4
this Part.
5
(2) Subsection (1) does not apply in relation to:
6
(a) grocery products sold in bulk; or
7
(b) an advertisement for a grocery product.
8
(3) A retailer must not contravene this section.
9
Civil penalty:
10
(a) for an individual:
11
(i) in the case of a first or second offence--100 penalty
12
units or such lower amount as is prescribed by the
13
regulations;
14
(ii) in the case of a third or subsequent offence--1,000
15
penalty units or such lower amount as is prescribed by
16
the regulations;
17
(b) for a body corporate:
18
(i) in the case of a first or second offence--1,000 penalty
19
units or such lower amount as is prescribed by the
20
regulations;
21
(ii) in the case of a third or subsequent offence--10,000
22
penalty units or such lower amount as is prescribed by
23
the regulations.

18ZZK Requirement to indicate unit price
25
(1) Subject to subsections (3) and (4), if a retailer indicates that any
26
grocery product is or may be for sale to a consumer, the retailer
27
must indicate the unit price of that grocery product in accordance
28
with this Part.
29
(2) The unit price indicated by the retailer must be accurate.
30
(3) Subsection (1) does not apply in relation to:
31
(a) any grocery product which is offered by a retailer to
32
consumers by means of an advertisement which is:
33
(i) purely aural; or

(ii) broadcast on television; or
1
(iii) shown at a cinema; or
2
(iv) inside a single premises shop; or
3
(b) any grocery product which comprises an assortment of
4
different items sold in a single package; or
5
(c) any grocery product the unit price of which is 0.0 cents as a
6
result of section 18ZZM; or
7
(d) any grocery product which is sold other than in bulk which is
8
or may be for sale:
9
(i) in a single premises shop; or
10
(ii) by an itinerant retailer.
11
(4) Subsection (1) applies in relation to an advertisement for a grocery
12
product unless the selling price of the grocery product is not
13
indicated in the advertisement.
14
(5) To avoid doubt, subsection (1) applies in relation to an
15
advertisement, product catalogue or any other promotional material
16
on the Internet in relation to a grocery product.
17
(6) A retailer must not contravene this section.

Civil penalty:
19
(a) for an individual:
20
(i) in the case of a first or second offence--100 penalty
21
units or such lower amount as is prescribed by the
22
regulations;
23
(ii) in the case of a third or subsequent offence--1,000
24
penalty units or such lower amount as is prescribed by
25
the regulations;
26
(b) for a body corporate:
27
(i) in the case of a first or second offence--1,000 penalty
28
units or such lower amount as is prescribed by the
29
regulations;
30
(ii) in the case of a third or subsequent offence--10,000
31
penalty units or such lower amount as is prescribed by
32
the regulations.

18ZZL Manner of indicating selling price and unit price etc.
1
(1) A retailer must ensure that the indication of the selling price, and if
2
appropriate the unit price, of a grocery product offered by the
3
retailer to consumers or to prospective consumers is:
4
(a) unambiguous and easily identifiable as referring to that
5
grocery product; and
6
(b) clearly visible and legible to consumers and prospective
7
consumers; and
8
(c) in proximity to:
9
(i) the grocery product; or
10
(ii) in the case of a grocery product for sale by distance
11
contract or an advertisement or product catalogue on the
12
Internet-- the description of the grocery product.
13
(2) A retailer must ensure that the font of the indication of the unit
14
price on shelf labels of a grocery product offered by the retailer to
15
consumers or to prospective consumers is the greater of:
16
(a) 10 millimetres; or
17
(b) 50 per cent of the size of the font of the indication of the
18
selling price.
19
(3) If, in addition to a unit price, a price per quantity is indicated in
20
relation to a supplementary indication of quantity, the unit price
21
must predominate and the price per supplementary indication of
22
quantity must be expressed in characters no larger than the unit
23
price.
24
(4) In the case of a pre-packaged solid food grocery product presented
25
in a liquid medium, the unit price refers to the net drained weight
26
of the grocery product. Where a unit price is also given with
27
reference to the net weight of the grocery product, it must be
28
clearly indicated which unit price relates to net drained weight and
29
which to net weight.
30
(5) A retailer must not contravene this section.
31
Civil penalty:
32
(a) for an individual:
33
(i) in the case of a first or second offence--50 penalty units
34
or such lower amount as is prescribed by the
35
regulations;

(ii) in the case of a third or subsequent offence--500

penalty units or such lower amount as is prescribed by
2
the regulations;
3
(b) for a body corporate:
4
(i) in the case of a first or second offence--500 penalty
5
units or such lower amount as is prescribed by the
6
regulations;
7
(ii) in the case of a third or subsequent offence--5,000
8
penalty units or such lower amount as is prescribed by
9
the regulations.

18ZZM Decimal places and rounding of unit prices
11
(1) If the unit price of a grocery product falls below $1 it must be
12
expressed to the nearest 0.1 cent. If the figure denoting one
13
hundredths of one cent in the unit price is 5 or higher, it must be
14
rounded up and if it is 4 or lower it must be rounded down.
15
(2) If the unit price of a grocery product falls above $1.00 it may be
16
expressed to the nearest:
17
(a) 1 cent, in which case if the figure denoting tenths of one cent
18
in the unit price is 5 or higher, it must be rounded up and if it
19
is 4 or lower it must be rounded down; or
20
(b) 0.1 cents, in which case if the figure denoting one hundredths
21
of one cents in the unit price is 5 or higher it must be rounded
22
up and if it is 4 or lower it must be rounded down.
23
Division 3--Other enforcement
24
Subdivision A--Infringement notices
25
18ZZN Infringement notices
26
(1) The Secretary may issue to a retailer who is alleged to have
27
contravened a provision of this Part an infringement notice
28
requiring the retailer to pay an infringement notice penalty to the
29
Commonwealth as an alternative to civil proceedings.
30
(2) The infringement notice penalty must not exceed one-fifth of the
31
maximum fine that a court could impose on the retailer as a civil
32
penalty for that contravention.

(3) The regulations may make further provision in relation to
1
infringement notices.

18ZZO Withdrawal of infringement notice
3
(1) This section applies if an infringement notice is given to a retailer.
4
(2) The Secretary may, by written notice (the withdrawal notice) given
5
to a retailer, withdraw the infringement notice.
6
(3) To be effective, the withdrawal notice must be given to the retailer
7
within 28 days after the infringement notice was given to the
8
retailer.
9
Refund of penalty if infringement notice withdrawn
10
(4) If:
11
(a) the penalty specified in the infringement notice is paid; and
12
(b) the infringement notice is withdrawn after the penalty is paid;
13
the Commonwealth is liable to refund the penalty.
14
18ZZP What happens if infringe ment notice penalty is paid
15
(1) This section applies if:
16
(a) an infringement notice relating to an alleged contravention of
17
a provision of this Part is given to a retailer; and
18
(b) the infringement notice penalty is paid in accordance with the
19
infringement notice.
20
(2) Any liability of the retailer for the alleged contravention is
21
discharged.
22
(3) Civil proceedings may not be brought against the retailer for the
23
alleged contravention.

18ZZQ Effect of Subdivision on civil proceedings
25
This Subdivision does not:
26
(a) require an infringement notice to be given in relation to an
27
alleged contravention of a provision of this Part; or
28
(b) affect the liability of a retailer to have civil or criminal
29
proceedings brought against the retailer for an alleged
30
contravention of a provision of this Part if:

(i) the retailer does not comply with an infringement notice
1
relating to the contravention by paying the infringement
2
notice penalty; or
3
(ii) an infringement notice relating to the contravention is
4
not given to the retailer; or
5
(iii) an infringement notice relating to the contravention is
6
given to the retailer and subsequently withdrawn.

Subdivision B--Publicising contraventions and offences
8
18ZZR Secretary may publicise contraventions and offences
9
(1) The Secretary may publicise, in any way he or she thinks
10
appropriate:
11
(a) a contravention against this Act for which a retailer has paid
12
an infringement notice penalty or a civil penalty; or
13
(b) an offence against this Act for which a retailer has been
14
convicted.
15
(2) This Subdivision does not:
16
(a) limit the Secretary's powers to publicise a contravention of,
17
or an offence against, this Act; or
18
(b) prevent anyone else from publicising a contravention of, or
19
an offence against, this Act; or
20
(c) affect any obligation (however imposed) on anyone to
21
publicise a contravention of, or an offence against, this Act.
22
Subdivision C--Enforceable undertakings
23
18ZZS Acceptance of undertakings
24
(1) This section applies if the Secretary considers that a retailer after
25
the commencement of this Part has contravened a provision of this
26
Part.
27
(2) The Secretary may accept a written undertaking given by the
28
retailer in connection with that contravention.
29
(2) The retailer may withdraw or vary the undertaking at any time, but
30
only with the consent of the Secretary.

18ZZT Enforce ment of undertakings
1
(1) If the Secretary considers that a retailer who gave an undertaking
2
under section 18ZZS has breached any of its terms, the Secretary
3
may apply to the Federal Court for an order under subsection (2).
4
(2) If the Federal Court is satisfied that the retailer has breached a term
5
of the undertaking, the Court may make one or more of the
6
following orders:
7
(a) an order directing the retailer to comply with that term of the
8
undertaking;
9
(b) any order that the Court considers appropriate directing the
10
retailer to compensate any person who has suffered loss or
11
damage as a result of the breach;
12
(c) any other order that the Court considers appropriate.
13
Subdivision D--Remedial directions
14
18ZZU Remedial directions
15
(1) This section applies if the Secretary is satisfied that a retailer has
16
contravened, or is contravening, a provision of this Part.
17
(2) The Secretary may give the retailer a written direction requiring the
18
retailer to take specified action directed towards ensuring that the
19
retailer does not contravene the provision, or is unlikely to
20
contravene the provision, in the future.
21
(3) The following are examples of the kinds of direction that may be
22
given to a retailer under subsection (2):
23
(a) a direction that the retailer implement effective
24
administrative systems for monitoring compliance with a
25
provision of this Part;
26
(b) a direction that the retailer implement a system designed to
27
give the retailer's officers, employees and agents a
28
reasonable knowledge and understanding of the requirements
29
of a provision of this Part, in so far as those requirements
30
affect the officers, employees or agents concerned.
31
(4) A retailer must not contravene a direction under subsection (2).

(a) for an individual:

(i) in the case of a first or second offence--10 penalty units

or such lower amount as is prescribed by the
2
regulations;
3
(ii) in the case of a third or subsequent offence--100
4
penalty units or such lower amount as is prescribed by
5
the regulations;
6
(b) for a body corporate:
7
(i) in the case of a first or second offence--100 penalty
8
units or such lower amount as is prescribed by the
9
regulations;
10
(ii) in the case of a third or subsequent offence--1,000
11
penalty units or such lower amount as is prescribed by
12
the regulations.
13
Remedial direction is not a legislative instrument
14
(5) A direction under subsection (2) is not a legislative instrument.
15
Subdivision E--Recovery of pecuniary penalties
16
18ZZV Civil action for recovery of pecuniary penalties
17
(1) The Secretary may institute a proceeding in the Federal Court for
18
the recovery on behalf of the Commonwealth of a pecuniary
19
penalty for a contravention of a provision of this Part.
20
(2) A proceeding under subsection (1) may be commenced within 6
21
years after the contravention.
22
(3) The Federal Court may direct that 2 or more proceedings under
23
subsection (1) are to be heard together.

18ZZW When contravention of provision is an offence
25
(1) Subject to subsection (2), criminal proceedings do not lie against a
26
retailer only because the retailer has contravened a provision of
27
Division 2 of this Part.
28
(2) If a retailer contravenes subsection 18ZZU(4) or a provision of
29
Division 2 of this Part, either:

(a) dishonestly, and intending to gain, whether directly or
1
indirectly, an advantage for the retailer or for any other
2
person; or
3
(b) intending to deceive or defraud someone;
4
the retailer is guilty of an offence.
5
Penalty:
6
(a) for an individual--imprisonment for not longer than 2 years;
7
(b) for a body corporate--$10,000.
8
Note:
Chapter 2 of the Criminal Code sets out the general principles of
9
criminal responsibility.

(3) A retailer who contravenes subsection 18ZZU(4) or a provision of
11
Division 2 of this Part is not guilty of an offence except as
12
provided by subsection (2).

Subdivision F--Injunctions
14
18ZZX Injunctions
15
(1) If a retailer has engaged, is engaging or is proposing to engage in
16
conduct that constituted, constitutes or would constitute, a
17
contravention of a provision of this Part, the Federal Court may, on
18
the application of the Secretary, grant an injunction:
19
(a) restraining the retailer from engaging in the conduct; or
20
(b) requiring the retailer to do an act or thing.
21
(2) On an application, the Federal Court may, if it thinks it appropriate,
22
grant an injunction by consent of all parties to the proceedings,
23
whether or not the Federal Court is satisfied that the retailer has
24
engaged, is engaging or is proposing to engage in any conduct that
25
constituted, constitutes or would constitute, a contravention of a
26
provision of this Part.
27
(3) The Federal Court may, if it thinks it desirable, grant an interim
28
injunction pending its determination of an application.
29
(4) The Federal Court is not to require the Secretary or anyone else, as
30
a condition of granting an interim injunction, to give an
31
undertaking as to damages.
32
(5) The Federal Court may discharge or vary an injunction it has
33
granted.

(6) The power to grant or vary an injunction restraining a retailer from

engaging in conduct may be exercised:

(a) whether or not it appears to the Federal Court that the retailer
3
intends to engage again, or to continue to engage, in such
4
conduct; and
5
(b) whether or not the retailer has previously engaged in such
6
conduct.
7
(7) The power to grant or vary an injunction requiring a retailer to do
8
an act or thing may be exercised:
9
(a) whether or not it appears to the Federal Court that the retailer
10
intends to refuse or fail again, or to continue to refuse or fail,
11
to do that act or thing; and
12
(b) whether or not the retailer has previously refused or failed to
13
do that act or thing and whether or not there is an imminent
14
danger of substantial damage to any person if the retailer
15
refuses or fails to do that act or thing.

The powers conferred on the Federal Court under this Part are in
18
addition to, and not instead of, any other powers of the Federal
19
Court, whether conferred by this Act or otherwise.

Division 4--Unit pricing inspectors
21
Subdivision A--Appointment of unit pricing inspectors and
22
identity cards
23
18ZZZ Appointment of unit pricing inspectors
24
(1) The Secretary may, in writing, appoint one or more of the
25
following persons to be a unit pricing inspector for the purposes of
26
exercising the powers of a unit pricing inspector under this
27
Division:
28
(a) an APS employee in the Department;
29
(b) an employee (whether or not an APS employee) of a
30
Commonwealth authority;
31
(c) the holder of an office established by or under a law of the
32
Commonwealth;
33
(d) a State or Territory officer.

(2) The Secretary may appoint a person mentioned in paragraph (1)(d)

only if the State or Territory concerned agrees to the appointment.

inspector, a unit pricing inspector must comply with any directions
4
of the Secretary.

18ZZZA Identity cards
9
(1) The Secretary must issue an identity card to a unit pricing inspector
10
in the form prescribed by the regulations. The identity card must
11
contain a recent photograph of the unit pricing inspector.
12
(2) A person is guilty of an offence if:
13
(a) the person has been issued with an identity card; and
14
(b) the person ceases to be a unit pricing inspector; and
15
(c) the person does not return the identity card to the Secretary as
16
soon as practicable.

Penalty: 1 penalty unit.

(3) A unit pricing inspector must carry the identity card at all times
21
when exercising powers or performing functions as a unit pricing
22
inspector.

Subdivision B--Powers of unit pricing inspectors
24
18ZZZB Powers available to unit pricing inspectors for monitoring
25
compliance
26
(1) For the purpose of finding out whether this Part or any regulations
27
made under this Part have been complied with, a unit pricing
28
inspector may:
29
(a) enter any business premises at any reasonable time of the
30
day; and
31
(b) exercise the powers set out in section 18ZZZD.

(2) A unit pricing inspector is not authorised to enter premises under
1
subsection (1) unless:
2
(a) the occupier of the premises has consented to the entry and
3
the inspector has shown his or her identity card if required by
4
the occupier; or
5
(b) the entry is made under a warrant issued under
6
section 18ZZZQ.
7
(3) If the unit pricing inspector is on premises with the consent of the
8
occupier, the unit pricing inspector must leave the premises if the
9
occupier asks the unit pricing inspector to do so.
10
18ZZZC Offence powe rs
11
(1) This section applies if a unit pricing inspector has reasonable
12
grounds for suspecting that there may be evidential material on any
13
business premises.
14
(2) The unit pricing inspector may:
15
(a) enter the premises:
16
(i) with the consent of the occupier after producing his or
17
her identity card for the inspection of the occupier; or
18
(ii) under a warrant issued under section 18ZZZR; and
19
(b) exercise the powers set out in section 18ZZZD in relation to
20
looking for the evidential material; and
21
(c) seize the evidential material, if the unit pricing inspector
22
finds it on the premises.
23
(3) If the evidential material referred to in subsection (1) is or includes
24
information in a written or electronic form, a unit pricing inspector
25
may operate equipment on the premises to see whether:
26
(a) the equipment; or
27
(b) a disk, tape or other storage device that:
28
(i) is on the premises; and
29
(ii) can be used with or is associated with the equipment;
30
contains the information.
31
(4) If the unit pricing inspector, after operating equipment at the
32
premises, finds that the equipment, or that a disk, tape or other
33
storage device at the premises contains the information, he or she
34
may:
35

(a) seize the equipment or the disk, tape or other storage device;
1
or
2
(b) if the information can, by using facilities at the premises, be
3
put in documentary form--operate the facilities to put the
4
information in that form and seize the documents so
5
produced; or
6
(c) if the information can be transferred to disk, tape or other
7
storage device that:
8
(i) is brought to the premises; or
9
(ii) is at the premises and whose use for the purpose has
10
been agreed to in writing by the occupier of the
11
premises;
12
operate the equipment or other facilities to copy the information to
13
the storage device and remove the storage device from the
14
premises.
15
(5) A unit pricing inspector may seize equipment under
16
paragraph (4)(a) only if:
17
(a) it is not practicable to put the relevant information in
18
documentary form as mentioned in paragraph (4)(b) or to
19
copy the records as mentioned in paragraph (4)(c); or
20
(b) possession by the occupier of the equipment could constitute
21
an offence.
22
(6) If:
23
(a) in the course of searching for a particular thing, a unit pricing
24
inspector finds another thing that the unit pricing inspector
25
believes on reasonable grounds to be evidential material; and
26
(b) the unit pricing inspector believes, on reasonable grounds,
27
that it is necessary to seize that other thing in order to prevent
28
its concealment, loss or destruction, or its use in committing,
29
continuing or repeating a contravention of a provision of this
30
Part or the regulations;
31
the unit pricing inspector may seize that other thing.
32
(7) If the unit pricing inspector is on premises with the consent of the
33
occupier, the unit pricing inspector must leave the premises if the
34
occupier asks the unit pricing inspector to do so.

(8) A person who obstructs or interferes with a unit pricing inspector

in the exercise of his or her powers under this section is guilty of
2
an offence.

18ZZZD General powers of unit pricing inspectors under this
7
Division
8
The powers that a unit pricing inspector may exercise in relation to
9
premises under sections 18ZZZB and 18ZZZC are as follows:
10
(a) to search the premises and any thing on the premises;
11
(b) to take photographs or make video or audio recordings or
12
sketches of the premises or any thing on the premises;
13
(c) to inspect any grocery products, indications of selling prices
14
or unit prices or records or documents on the premises;
15
(d) to take any such indications of selling prices or unit prices or
16
make copies of them;
17
(e) to take extracts from or make copies of any such record or
18
document;
19
(f) to take onto the premises such equipment and materials as the
20
unit pricing inspector requires for the purpose of exercising
21
powers in relation to the premises.
22
18ZZZE Unit pricing inspector may request persons to answer
23
questions
24
(1) If the unit pricing inspector was only authorised to enter business
25
premises because the occupier of the premises consented to the
26
entry--the unit pricing inspector may ask the occupier to:
27
(a) answer any questions put by the unit pricing inspector; and
28
(b) produce any record or document requested by the unit pricing
29
inspector.
30
(2) If the unit pricing inspector was authorised to enter the premises by
31
a warrant under section 18ZZZQ or 18ZZZR--the unit pricing
32
inspector has power to require any person in or on the premises to:
33
(a) answer any questions put by the unit pricing inspector; and
34

(b) produce any record or document requested by the unit

(3) A person is guilty of an offence if the person refuses or fails to

answer to the question or the production of the record or document

(5) A person is guilty of an offence if the person:

a material particular.

Subdivision C--Obligations of unit pricing inspectors

18ZZZF Unit pricing inspector must produce identity card on
23
request
24
A unit pricing inspector is not entitled to exercise any powers
25
under this Division in relation to premises if:
26
(a) the occupier of the premises requires the unit pricing
27
inspector to produce his or her identity card for inspection by
28
the occupier; and
29
(b) the unit pricing inspector fails to comply with the
30
requirement.

18ZZZG Details of warrant to be given to occupier etc.
1
(1) If a warrant in relation to business premises is being executed and
2
the occupier of the premises or another person who apparently
3
represents the occupier is present at the premises, the unit pricing
4
inspector must make available to that person a copy of the warrant.
5
(2) The unit pricing inspector must identify himself or herself to that
6
person.
7
(3) The copy of the warrant referred to in subsection (1) need not
8
include the signature of the magistrate who issued the warrant.

18ZZZH Consent
11
(1) Before obtaining the consent of a person for the purposes of
12
paragraph 18ZZZB(2)(a) and subparagraph 18ZZZC(2)(a)(i), the
13
unit pricing inspector must inform the person that he or she may
14
refuse consent.
15
(2) An entry of a unit pricing inspector by virtue of the consent of a
16
person is not lawful unless the person voluntarily consented to the
17
entry.
18
18ZZZI Announcement before entry
19
A unit pricing inspector must, before entering premises under a
20
warrant:
21
(a) announce that he or she is authorised to enter the premises;
22
and
23
(b) give any person at the premises an opportunity to allow entry
24
to the premises.
25
18ZZZJ Compensation for damage to electronic equipment
26
(1) This section applies if:
27
(a) as a result of equipment being operated as mentioned in
28
section 18ZZZC:
29
(i) damage is caused to the equipment; or
30
(ii) the data recorded on the equipment is damaged; or
31

(iii) programs associated with the use of the equipment, or
1
with the use of the data, are damaged or corrupted; and
2
(b) the damage or corruption occurs because:

(i) insufficient care was exercised in selecting the person
4
who was to operate the equipment; or
5
(ii) insufficient care was exercised by the person operating
6
the equipment.
7
(2) The Commonwealth must pay the owner of the equipment, or the
8
user of the data or programs, such reasonable compensation for the
9
damage or corruption as the Commonwealth and the owner or user
10
agree on.
11
(3) However, if the owner or user and the Commonwealth fail to
12
agree, the owner or user may institute proceedings in the Federal
13
Court of Australia for such reasonable amount of compensation as
14
the Court determines.
15
(4) In determining the amount of compensation payable, regard is to
16
be had to whether the occupier of the premises, or the occupier's
17
employees or agents, if they were available at the time, provided
18
any appropriate warning or guidance on the operation of the
19
equipment.
20
(5) For the purposes of subsection (1):
21
damage, in relation to data, includes damage by erasure of data or
22
addition of other data.
23
18ZZZK Copies of seized things to be provided
24
(1) Subject to subsection (2), if a unit pricing inspector seizes, under a
25
warrant in relation to premises:
26
(a) a document, film, computer file or other thing that can be
27
readily copied; or
28
(b) a storage device the information in which can be readily
29
copied;
30
the unit pricing inspector must, if requested to do so by the
31
occupier of the premises or another person who apparently
32
represents the occupier and who is present when the warrant is
33
executed, give a copy of the thing or the information to that person
34
as soon as practicable after the seizure.

(2) Subsection (1) does not apply if:
1
(a) the thing that has been seized was seized under paragraph
2
18ZZZC(4)(b) or (c); or
3
(b) possession by the occupier of the document, film, computer
4
file, thing or information could constitute an offence.
5
18ZZZL Receipts for things seized unde r warrant
6
(1) If a thing is seized under this Division, the unit pricing inspector
7
must provide a receipt for the thing.
8
(2) If 2 or more things are seized or moved, they may be covered in
9
the one receipt.
10
18ZZZM Retention of seized things
11
(1) Subject to any contrary order of a court, if a unit pricing inspector
12
seizes a thing under this Division, a unit pricing inspector must
13
return it if:
14
(a) the reason for its seizure no longer exists or it is decided that
15
it is not to be used in evidence; or
16
(b) the period of 60 days after its seizure ends;
17
whichever first occurs.
18
(2) At the end of the 60 days specified in subsection (1), a unit pricing
19
inspector must take reasonable steps to return the thing to the
20
person from whom it was seized, unless:
21
(a) proceedings in respect of which the thing may afford
22
evidence were instituted before the end of the 60 days and
23
have not been completed (including an appeal to a court in
24
relation to those proceedings); or
25
(b) the unit pricing inspector may retain the thing because of an
26
order under section 18ZZZN; or
27
(c) a unit pricing inspector is otherwise authorised (by a law, or
28
an order of a court, of the Commonwealth or of a State or
29
Territory) to retain, destroy or dispose of the thing.
30
(3) The thing may be returned under subsection (2) either
31
unconditionally or on such terms and conditions as the Secretary
32
sees fit.

18ZZZN Magistrate may permit a thing to be retained
1
(1) A unit pricing inspector may apply to a magistrate for an order that
2
he or she may retain the thing for a further period if:
3
(a) before the end of 60 days after the seizure; or
4
(b) before the end of a period previously specified in an order of
5
a magistrate under this section;
6
proceedings in respect of which the thing may afford evidence
7
have not commenced.
8
(2) If the magistrate is satisfied that it is necessary for a unit pricing
9
inspector to continue to retain the thing:
10
(a) for the purposes of an investigation as to whether a
11
contravention of a provision of this Part has been committed;
12
or
13
(b) to enable evidence of a contravention of a provision of this
14
Part to be secured for the purposes of civil or criminal
15
proceedings;
16
the magistrate may order that a unit pricing inspector may retain
17
the thing for a period (not being a period exceeding 3 years)
18
specified in the order.
19
(3) Before making the application, the unit pricing inspector must:
20
(a) take reasonable steps to discover who has an interest in the
21
retention of the thing; and
22
(b) if it is practicable to do so, notify each person whom the unit
23
pricing inspector believes to have such an interest of the
24
proposed application.
25
Subdivision D--Occupier's rights and responsibilities
26
18ZZZO Occupie r entitled to be present during search
27
(1) If a warrant in relation to business premises is being executed and
28
the occupier of the premises, or another person who apparently
29
represents the occupier is present at the premises, the person is
30
entitled to observe the search being conducted.
31
(2) The right to observe the search being conducted ceases if the
32
person impedes the search.

(3) This section does not prevent 2 or more areas of the premises being

searched at the same time.

18ZZZP Occupier to provide unit pricing inspector with all facilities
3
and assistance
4
The occupier, or another person who apparently represents the
5
occupier, of business premises to which a monitoring warrant or an
6
offence warrant relates must provide the executing officer in
7
relation to the warrant and any person assisting that officer with all
8
reasonable facilities and assistance for the effective exercise of
9
their powers.
10
Subdivision E--Warrants
11
18ZZZQ Monitoring warrants
12
(1) A unit pricing inspector may apply to a magistrate for a warrant
13
under this section in relation to business premises.
14
(2) Subject to subsection (3), the magistrate may issue the warrant if
15
the magistrate is satisfied, by information on oath, that it is
16
reasonably necessary that one or more unit pricing inspectors
17
should have access to the premises for the purposes of finding out
18
whether this Part or the regulations under this Part have been
19
complied with.
20
(3) The magistrate must not issue the warrant unless the unit pricing
21
inspector or some other person has given to the magistrate, either
22
orally or by affidavit, such further information (if any) as the
23
magistrate requires concerning the grounds on which the issue of
24
the warrant is being sought.
25
(4) The warrant must:
26
(a) authorise one or more unit pricing inspectors (whether or not
27
named in the warrant), with such assistance and by such force
28
as is necessary and reasonable:
29
(i) to enter the premises; and
30
(ii) to exercise the powers set out in section 18ZZZD in
31
relation to the premises; and
32
(b) state whether the entry is authorised to be made at any time
33
of the day or during specified hours of the day; and
34

(c) specify the day (not more than 6 months after the issue of the

warrant) on which the warrant ceases to have effect; and

18ZZZR Offence related warrants
4
(1) A unit pricing inspector may apply to a magistrate for a warrant
5
under this section in relation to business premises.
6
(2) Subject to subsection (3), the magistrate may issue the warrant if
7
the magistrate is satisfied, by information on oath, that there are
8
reasonable grounds for suspecting that there is, or there may be
9
within the next 72 hours, in or on the premises evidential material.
10
(3) The magistrate must not issue the warrant unless the unit pricing
11
inspector or some other person has given to the magistrate, either
12
orally or by affidavit, such further information (if any) as the
13
magistrate requires concerning the grounds on which the issue of
14
the warrant is being sought.
15
(4) The warrant must:
16
(a) name one or more unit pricing inspectors; and
17
(b) authorise the persons so named, with such assistance and by
18
such force as is necessary and reasonable:
19
(i) to enter the premises; and
20
(ii) to exercise the powers set out in sections 18ZZZC and
21
18ZZZD; and
22
(iii) to seize the evidential material; and
23
(c) state whether the entry is authorised to be made at any time
24
of the day or during specified hours of the day; and
25
(d) specify the day (not more than one week after the issue of the
26
warrant) on which the warrant ceases to have effect; and
27
(e) state the purpose for which the warrant is issued.
28
18ZZZS Offence related warrants by telephone
29
(1) If, in an urgent case, a unit pricing inspector considers it necessary
30
to do so, the unit pricing inspector may apply to a magistrate by
31
telephone for a warrant under section 18ZZZR in relation to
32
business premises.

(2) Before applying for the warrant, the unit pricing inspector must
1
prepare an information of the kind mentioned in subsection
2
18ZZZR(2) in relation to the premises that sets out the grounds on
3
which the warrant is sought.
4
(3) If it is necessary to do so, the unit pricing inspector may apply for
5
the warrant before the information is sworn.
6
(4) If the magistrate is satisfied:
7
(a) after having considered the terms of the information; and
8
(b) after having received such further information (if any) as the
9
magistrate requires concerning the grounds on which the
10
issue of the warrant is being sought;
11
that there are reasonable grounds for issuing the warrant, the
12
magistrate may complete and sign the same warrant that the
13
magistrate would issue under section 18ZZZR if the application
14
had been made under that section.
15
(5) If the magistrate completes and signs the warrant:
16
(a) the magistrate must:
17
(i) tell the unit pricing inspector what the terms of the
18
warrant are; and
19
(ii) tell the unit pricing inspector the day on which and the
20
time at which the warrant was signed; and
21
(iii) tell the unit pricing inspector the day (not more than one
22
week after the magistrate completes and signs the
23
warrant) on which the warrant ceases to have effect; and
24
(iv) record on the warrant the reasons for granting the
25
warrant; and
26
(b) the unit pricing inspector must:
27
(i) complete a form of warrant in the same terms as the
28
warrant completed and signed by the magistrate; and
29
(ii) write on the form the name of the magistrate and the
30
day on which and the time at which the warrant was
31
signed.
32
(6) The unit pricing inspector must also, not later than the day after the
33
day of expiry or execution of the warrant, whichever is the earlier,
34
send to the magistrate:
35
(a) the form of warrant completed by the unit pricing inspector;
36
and

(b) the information referred to in subsection (2), which must
1
have been duly sworn.

(7) When the magistrate receives those documents, the magistrate
3
must:
4
(a) attach them to the warrant that the magistrate completed and
5
signed; and
6
(b) deal with them in the way in which the magistrate would
7
have dealt with the information if the application had been
8
made under section 18ZZZR.
9
(8) A form of warrant duly completed under subsection (5) is authority
10
for any entry, search, seizure or other exercise of a power that the
11
warrant signed by the magistrate authorises.
12
(9) If:
13
(a) it is material, in any proceedings, for a court to be satisfied
14
that an exercise of a power was authorised by this section;
15
and
16
(b) the warrant signed by the magistrate authorising the exercise
17
of the power is not produced in evidence;
18
the court must assume, unless the contrary is proved, that the
19
exercise of the power was not authorised by such a warrant.
20
(10) A reference in this Division to a warrant under section 18ZZZR
21
includes a reference to a warrant signed by a magistrate under this
22
section.

Division 5--Additional functions of Secretary
24
18ZZZT Additional functions of Secretary
25
(1) In addition to any other functions under this Act, the Secretary has
26
the following guidance functions in relation to this Part:
27
(a) to issue minimum standards of procedures that retailers can
28
implement in order to ensure that they comply with this Part;
29
(b) to promote an understanding and acceptance of unit pricing;
30
(c) to prepare, and to publish in the way that the Secretary
31
considers appropriate, guidelines for the avoidance of acts or
32
practices of a retailer that may or might contravene this Part;
33

(d) to prepare, and to publish in the way that the Secretary
1
considers appropriate, guidelines and advices to assist
2

compliance with this Part;

(e) to evaluate compliance with minimum standards issued under
5
paragraph (a);
6
(f) to do anything incidental or conducive to the performance of
7
any of the preceding functions.

(2) The Secretary may do all things that are necessary or convenient to
