1 Short title

This Act may be cited as the Transport Safety Investigation
5
Amendment Act 2009.

2 Commence ment

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

(ATSB)
5
The Australian Transport Safety Bureau (ATSB) is established by
6
this section.
7
12A Constitution of the ATSB
8
(1) The ATSB consists of:
9
(a) a Chief Commissioner; and
10
(b) 2 or more Commissioners.
11
(2) The performance of a function or the exercise of a power of the
12
ATSB is not affected by a vacancy in the membership of the
13
ATSB.

12AA Functions of the ATSB
15
(1) The ATSB's function is to improve transport safety by means that
16
include the following:
17
(a) receiving and assessing reports of transport safety matters,
18
reportable matters, and other safety information that is
19
prescribed by the regulations;
20
(b) independently investigating transport safety matters;
21
(c) identifying factors that:
22
(i) contribute, or have contributed, to transport safety
23
matters; or
24
(ii) affect, or might affect, transport safety;
25
(d) communicating those factors to relevant sectors of the
26
transport industry and the public in any way, including in any
27
one or more of the following ways:
28
(i) by making safety action statements;
29
(ii) by making safety recommendations;
30
(iii) by issuing safety advisory notices;

(e) reporting publicly on those investigations;
1
(f) conducting public educational programs about matters
2
relating to transport safety;
3
(g) any other means prescribed by the regulations.

(2) The ATSB also has the following functions:
5
(a) cooperating with:
6
(i) an agency of the Commonwealth, a State or Territory
7
that has functions or powers relating to transport safety
8
or functions affected by the ATSB's function of
9
improving transport safety; and
10
(ii) a person who has, under a law of the Commonwealth, a
11
State or Territory, functions or powers relating to
12
transport safety or functions affected by the ATSB's
13
function of improving transport safety; and
14
(iii) a national authority or other body of another country
15
that has functions or powers relating to transport safety
16
or functions affected by the ATSB's function of
17
improving transport safety;
18
(b) doing anything incidental to its function of improving
19
transport safety.
20
(3) The following are not functions of the ATSB:
21
(a) to apportion blame for transport safety matters;
22
(b) to provide the means to determine the liability of any person
23
in respect of a transport safety matter;
24
(c) to assist in court proceedings between parties (except as
25
provided by this Act, whether expressly or impliedly);
26
(d) to allow any adverse inference to be drawn from the fact that
27
a person was involved in a transport safety matter.
28
However, even though blame or liability may be inferred, or an
29
adverse inference may be made, by a person other than the ATSB,
30
this does not prevent the ATSB from carrying out its functions.
31
(4) To avoid doubt, subsection (3) does not prevent the prosecution of
32
any offence under this Act.

12AB Independence of the ATSB and Chief Commissioner
1
(1) Subject to section 21, the ATSB is not subject to direction from
2
anyone in relation to the performance of its functions or the
3
exercise of its powers.
4
(2) The Chief Commissioner is not subject to direction from anyone in
5
relation to the exercise of his or her powers. However, when
6
exercising his or her powers, the Chief Commissioner must act
7
consistently with the ATSB in the performance of its functions or
8
the exercise of its powers.
9
Note:
This means that the ATSB and the Chief Commissioner would not, for
10
example, be subject to direction from anyone in relation to:
11
(a)
how a particular investigation will be carried out; or
12
(b)
the content of a public report on a particular investigation.
13
12AC Minimal disruption to transport services
14
In exercising powers under this Act, the ATSB and the Chief
15
Commissioner must have regard to the desirability of minimising
16
any resulting disruption to transport by means of transport vehicles.
17
12AD International obligations
18
(1) The ATSB must ensure that the ATSB's powers under this Act are
19
exercised in a manner that is consistent with Australia's obligations
20
under international agreements (as in force from time to time) that
21
are identified by the regulations for the purpose of this section.
22
(2) The Chief Commissioner must ensure that the Chief
23
Commissioner's powers under this Act are exercised in a manner
24
that is consistent with Australia's obligations under international
25
agreements (as in force from time to time) that are identified by the
26
regulations for the purpose of this section.
27
(3) In exercising powers under this Act, the ATSB and the Chief
28
Commissioner must also have regard to any rules,
29
recommendations, guidelines, codes or other instruments (as in
30
force from time to time) that are promulgated by an international
31
organisation and that are identified by the regulations for the
32
purposes of this section.

12AE Minister may give the ATSB notices about its strategic
1
direction
2
(1) The Minister may, by written instrument, notify the ATSB of the
3
Minister's views on the appropriate strategic direction for the
4
ATSB.
5
(2) Subject to section 12AB, the ATSB must have regard to a
6
notification given under subsection (1).
7
(3) A notification given under subsection (1) is not a legislative
8
instrument.

Division 2--Appointment of Commissioners
10
13 Appointment
11
(1) The Chief Commissioner is to be appointed by the Minister by
12
written instrument, on a full-time basis.

Note:
The Chief Commissioner is also the Chief Executive Officer: see
14
section 15.
15
(2) Other Commissioners are to be appointed by the Minister by
16
written instrument, on a part-time basis.
17
(3) A person is eligible to be appointed as a Commissioner only if the
18
person has a high level of expertise in one or more areas relevant to
19
the ATSB's functions.
20
(4) A person's appointment as a Commissioner is not invalid because
21
of a defect or irregularity in connection with the person's
22
appointment.
23
13A Term of appointment
24
(1) The Chief Commissioner holds office for the period specified in
25
the instrument of appointment. The period must not exceed 5 years.
26
(2) A part-time Commissioner holds office for the period specified in
27
the instrument of appointment. The period must not exceed 3 years.

Note:
A Commissioner is eligible for reappointment: see subsection 33(4A)
29
of the Acts Interpretation Act 1901.

13AA Remuneration and allowances
1
(1) A Commissioner is to be paid such remuneration as is determined
2
by the Remuneration Tribunal. If no determination of that
3
remuneration is in operation, the Commissioner is to be paid such
4
remuneration as is prescribed.
5
(2) A Commissioner is to be paid the allowances that are prescribed.
6
(3) This section has effect subject to the Remuneration Tribunal Act
7
1973.

13AB Leave of absence
9
(1) The Chief Commissioner has the recreation leave entitlements that
10
are determined by the Remuneration Tribunal.
11
(2) The Minister may grant to the Chief Commissioner leave of
12
absence, other than recreation leave, on the terms and conditions as
13
to remuneration that the Minister determines.
14
(3) The Chief Commissioner may grant leave of absence to a part-time
15
Commissioner on the terms and conditions that the Chief
16
Commissioner determines.
17
13AC Outside employme nt
18
(1) The Chief Commissioner must not engage in paid employment
19
outside the duties of the Chief Commissioner's office without the
20
Minister's written consent.
21
(2) A part-time Commissioner must not engage in any paid
22
employment that conflicts or may conflict with the proper
23
performance of his or her duties without the Minister's written
24
consent.

13AD Resignation
26
(1) A Commissioner may resign by giving to the Minister a signed
27
notice of resignation.
28
(2) If the Chief Commissioner resigns, he or she also resigns his or her
29
position as the Chief Executive Officer.

Note:
Subsection (2) does not prevent a person who is both the Chief
1
Commissioner and the Chief Executive Officer from being
2
re-appointed only as a part-time Commissioner.

(3) The resignation takes effect on the day on which it is received by
4
the Minister or, if a later day is specified in the resignation, on that
5
later day.

13AE Disclosure of inte rests to the Minister
7
A Commissioner must give written notice to the Minister of all
8
interests, pecuniary or otherwise, that the Commissioner has or
9
acquires and that conflict or could conflict with the proper
10
performance of the ATSB's functions.

13AF Other terms and conditions
12
A Commissioner holds office on such terms and conditions (if any)
13
in relation to matters not provided for by this Act as are
14
determined, in writing, by the Minister.
15
13AG Termination of appointment
16
All Commissioners
17
(1) The Minister may terminate the appointment of a Commissioner:
18
(a) for misbehaviour or physical or mental incapacity; or
19
(b) if the Commissioner:
20
(i) becomes bankrupt; or
21
(ii) applies to take the benefit of any law for the relief of
22
bankrupt or insolvent debtors; or
23
(iii) compounds with his or her creditors; or
24
(iv) makes an assignment of his or her remuneration for the
25
benefit of his or her creditors; or
26
(c) if the Commissioner fails, without reasonable excuse, to
27
comply with section 13AE.
28
Additional grounds: Chief Commissioner
29
(2) The Minister may terminate the appointment of the Chief
30
Commissioner if:

(a) the Commissioner is absent, except on leave of absence, for
1
14 consecutive days or for 28 days in any 12 months; or
2
(b) the Commissioner engages, except with the Minister's
3
written consent, in paid employment outside the duties of his
4
or her office.

Additional grounds: part-time Commissioners
6
(3) The Minister may terminate the appointment of a part-time
7
Commissioner if:
8
(a) the Commissioner engages, except with the Minister's
9
written consent, in paid employment that conflicts or may
10
conflict with the proper performance of the Commissioner's
11
duties; or
12
(b) the Commissioner is absent, except on leave of absence
13
granted under section 13AB, from 3 consecutive meetings of
14
the ATSB.

13AH Acting Chief Commissioner
16
(1) The Minister may appoint a person to act as the Chief
17
Commissioner:
18
(a) during a vacancy in the office of the Chief Commissioner,
19
(whether or not an appointment has previously been made to
20
the office); or
21
(b) during any period, or during all periods, when the Chief
22
Commissioner:
23
(i) is absent from duty or from Australia; or
24
(ii) is, for any reason, unable to perform the duties of the
25
office.
26
(2) To avoid doubt, a part-time Commissioner or staff member (within
27
the meaning of paragraph (b) of the definition of that expression)
28
may be appointed to act as the Chief Commissioner.
29
(3) Anything done by or in relation to a person purporting to act under
30
an appointment is not invalid merely because:
31
(a) the occasion for the appointment had not arisen; or
32
(b) there is a defect or irregularity in connection with the
33
appointment; or
34
(c) the appointment had ceased to have effect; or

(d) the occasion to act had not arisen or had ceased.

Division 3--ATSB procedures

Subdivision A--Meetings

14 Times and places of meetings
5
(1) The Chief Commissioner must hold such meetings as are necessary
6
for the efficient performance of the ATSB's functions.
7
(2) Meetings are to be held at such times and places as the Chief
8
Commissioner decides.

14A Conduct of meetings
10
Presiding at meetings
11
(1) The Chief Commissioner presides at all meetings at which he or
12
she is present.
13
(2) If the Chief Commissioner is not present at a meeting, a person
14
appointed to act as the Chief Commissioner must be present and
15
preside.
16
Quorum
17
(3) At a meeting of the ATSB, a quorum is constituted by 2
18
Commissioners.
19
Rules of procedure
20
(4) The ATSB may, subject to this Subdivision, regulate proceedings
21
at its meetings as it considers appropriate.

Note:
Section 33B of the Acts Interpretation Act 1901 provides for
23
participation in meetings by telephone etc.

Voting
25
(5) The person presiding at a meeting of the ATSB has a deliberative
26
vote and, if the votes are equal, also has a casting vote.

(6) The ATSB must ensure that minutes of its meetings are kept.

14AA Disclosure of interests
3
(1) If a Commissioner has an interest, pecuniary or otherwise, in a
4
matter being considered, or about to be considered, at the meeting,
5
the Commissioner must disclose the nature of that interest to the
6
other Commissioners.
7
(2) The disclosure must be made as soon as possible after the relevant
8
facts have come to the Commissioner's knowledge.
9
(3) The disclosure must be recorded in the minutes of the meeting.
10
(4) Unless the ATSB otherwise determines, the Commissioner:
11
(a) must not be present during the ATSB's deliberation on the
12
matter; and
13
(b) must not take part in the ATSB's decision on the matter.
14
(5) A determination under subsection (4) must be recorded in the
15
minutes of the meeting.

Subdivision B--Decisions without meetings
17
14AB Decisions without meetings
18
(1) A decision is taken to have been made at a meeting of the ATSB if:
19
(a) without meeting, a majority of Commissioners indicate
20
agreement with the proposed decision in accordance with the
21
method determined by the ATSB under subsection (2); and
22
(b) all Commissioners were informed of the proposed decision,
23
or reasonable efforts were made to inform all Commissioners
24
of the proposed decision.
25
(2) Subsection (1) applies only if the ATSB:
26
(a) has determined that it applies; and
27
(b) has determined the method by which Commissioners are to
28
indicate agreement with proposed decisions.

14AC Record of decisions
1
The ATSB must keep a record of decisions made in accordance
2
with section 14AB.

Division 4--Chief Executive Officer

15 Chief Executive Officer

(1) There is to be a Chief Executive Officer of the ATSB.
6
(2) The Chief Commissioner is the Chief Executive Officer.

15A Functions of the Chief Executive Officer
8
(1) The Chief Executive Officer is to manage the ATSB in accordance
9
with the policies determined by the ATSB.
10
(2) All acts and things done in the name of, or on behalf of, the ATSB
11
by the Chief Executive Officer are taken to have been done by the
12
ATSB.

Division 5--Staff and consultants
14
16 Staff
15
(1) The staff of the ATSB are to be persons engaged under the Public
16
Service Act 1999.
17
(2) For the purposes of the Public Service Act 1999:
18
(a) the Chief Executive Officer and the staff of the ATSB
19
together constitute a Statutory Agency; and
20
(b) the Chief Executive Officer is the Head of that Statutory
21
Agency.

16A Staff to be made available to the ATSB
23
(1) The ATSB is to be assisted by:
24
(a) officers and employees of Agencies (within the meaning of
25
the Public Service Act 1999), and of authorities of the
26
Commonwealth, whose services are made available to the
27

ATSB in connection with the performance of its functions or
1
the exercise of its powers; and
2
(b) persons whose services are made available under
3
arrangements made under subsection (2).

(2) The Chief Executive Officer may arrange with the appropriate
5
authority or officer of the government of a State or Territory for the
6
State or Territory to make officers or employees available to the
7
ATSB to perform services in connection with the performance of
8
the ATSB's functions or the exercise of its powers.
9
(3) An arrangement under subsection (2) may provide for the
10
Commonwealth to reimburse a State or Territory with respect to
11
the services of a person or persons to whom the arrangement
12
relates.
13
(4) When performing services for the ATSB under this section, a
14
person is subject to the directions of the Chief Executive Officer.

16B Consultants
16
(1) The ATSB may engage persons having suitable qualifications and
17
experience as consultants to the ATSB.
18
(2) The terms and conditions of engagement are to be determined by
19
the Chief Executive Officer.

If, before 1 July 2009, the Executive Director was conducting an

investigation under the old law, then the ATSB may continue the
15
investigation.

(2)
Anything done by, or in relation to, the Executive Director under such
17
an investigation is taken, for the purposes of the operation of any law on
18
and after 1 July 2009, to have been done by, or in relation to, the ATSB
19
or the Chief Commissioner, as the case requires.
20
(3)
The Minister may, by writing, determine that subitem (2) does not apply
21
in relation to a specified thing done by, or in relation to, the Executive
22
Director.
23
(4)
To avoid doubt, doing a thing includes making an instrument.
24
(5)
A determination under subitem (3) is not a legislative instrument.

106 Exercise of powers in relation to completed
26
investigations
27
The ATSB, or the Chief Commissioner, may perform functions or
28
exercise powers under:
29
(a) the old law; or

(b) Part 2A of the Air Navigation Act 1920 (as continued in force

(c) the Navigation (Marine Casualty) Regulations 1990 (as
4
continued in force by subitem 108(2) of this Schedule);
5
in relation to an investigation that was completed before 1 July 2009
6
under any of those laws.

107 Performance of functions and exercise of powers in

relation to voluntary reporting schemes

The ATSB, or the Chief Commissioner, may perform functions or
10
exercise powers conferred on the Executive Director under:
11
(a) the Navigation (Confidential Marine Reporting Scheme)
12
Regulations 2008; and
13
(b) the Air Navigation (Confidential Reporting) Regulations
14
2006; and
15
(c) Division 13.K.1 of Part 13 of the Civil Aviation Safety
16
Regulations 1998;
17
on and after the date that this item commences until the regulations
18
mentioned in paragraphs (a), (b) and (c) are repealed.

108 Validation of acts done under investigations conducted
20
under the Navigation Act 1912

(1)
To avoid doubt, any thing done by a person:
22
(a) in the performance or purported performance of a function;
23
or
24
(b) in the exercise or purported exercise of a power;
25
under an investigation conducted under the Navigation (Marine
26
Casualty) Regulations 1990 is taken always to have been validly
27
performed or exercised, as it would have been had paragraph 425(1)(ea)
28
and subsection 425(1AAA) of the Navigation Act 1912 not been
29
repealed by items 8 and 9 of the Transport Safety Investigation
30
(Consequential Amendments) Act 2003.

(2)
For the purpose of paragraph 106(c) of this Part, paragraph 425(1)(ea)
32
and subsection 425(1AAA) of the Navigation Act 1912 continue in
33
force, despite their repeal by items 8 and 9 of the Transport Safety
34
Investigation (Consequential Amendments) Act 2003.

20A Voluntary reporting scheme
2
(1) The regulations may establish a scheme for the voluntary and
3
confidential reporting of issues that affect, or might affect,
4
transport safety to the ATSB.
5
(2) The regulations may prescribe:
6
(a) the purposes of the scheme; and
7
(b) the manner in which reports are to be made; and
8
(c) the use and disclosure by the ATSB of:
9
(i) information contained in a report; or
10
(ii) information the ATSB obtains or generates in the course
11
of considering the report; and
12
(d) any other matters necessary or incidental to the establishment
13
or operation of a scheme in accordance with subsection (1).

25A Responses to reports of, or containing, safety recommendations
17
(1) This section applies if:
18
(a) the ATSB publishes a report under section 25 in relation to
19
an investigation; and
20
(b) the report is, or contains, a recommendation that a person,
21
unincorporated association, or an agency of the
22
Commonwealth or of a State or Territory, take safety action.
23
(2) The person, association or agency to whom the recommendation is
24
made must give a written response to the ATSB, within 90 days of
25
the report being published, that sets out:
26
(a) whether the person, association or agency accepts the
27
recommendation (in whole or in part); and
28
(b) if the person, association or agency accepts the
29
recommendation (in whole or in part)--details of any action
30
that the person, association or agency proposes to take to give
31
effect to the recommendation; and

(c) if the person, association or agency does not accept the

recommendation (in whole or in part)--the reasons why the
2
person, association or agency does not accept the

recommendation (in whole or in part).

(3) A person commits an offence if:
5
(a) the person is someone to whom a recommendation is made in
6
a report published under section 25; and
7
(b) the person fails to give a written response to the ATSB within
8
90 days setting out the things required by paragraphs (2)(a),
9
(b) and (c) (as applicable).
10
Penalty: 30 penalty units.
11
(4) Subsection (3) applies to an unincorporated association as if it were
12
a person.
13
(5) An offence against subsection (3) that would otherwise be
14
committed by an unincorporated association is taken to have been
15
committed by each member of the association's committee of
16
management, at the time the offence is committed, who:
17
(a) made the relevant omission; or
18
(b) aided, abetted, counselled or procured the relevant omission;
19
or
20
(c) was in any way knowingly concerned in, or party to, the
21
relevant omission (whether directly or indirectly or whether
22
by any act or omission of the member).
