The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Tobacco Advertising Prohibition
5
Amendment Act 2010.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

Offence
27
(1) A person commits an offence if:
28
(a) the person publishes something, or authorises or causes
29
something to be published; and
30
(b) the thing is a tobacco advertisement; and

(c) the tobacco advertisement is published electronically; and

(d) the tobacco advertisement is published in Australia.

Penalty: 120 penalty units.

Exceptions
4
(2) Subsection (1) does not apply to the publication of a tobacco
5
advertisement if its publication is permitted by any of
6
sections 16A, 16B, 17, 19 and 20.

subsection (2): see subsection 13.3(3) of the Criminal Code.

Geographical application
10
(3) Section 15.2 of the Criminal Code (extended geographical
11
jurisdiction--category B) applies to an offence against
12
subsection (1).

Meaning of published in Australia
14
(4) In this section, a tobacco advertisement that is published
15
electronically is published in Australia if:
16
(a) the advertisement originates in Australia; or
17
(b) all of the following apply:
18
(i) the advertisement did not originate in Australia, or the
19
advertisement's origin cannot be determined;
20
(ii) the advertisement has an Australian link;
21
(iii) the advertisement is accessible, or intended to be
22
accessible, by the public, or a section of the public, in
23
Australia.
24
(5) A tobacco advertisement has an Australian link if:
25
(a) at a particular time, the advertisement is published, or
26
authorised or caused to be published, by an entity, or the
27
person or persons constituting or responsible for an entity;
28
and
29
(b) at that time, the circumstances described in the following
30
table apply to the entity.

16A Point of sale advertising permitted--internet sales
5
(1) A person may publish a tobacco advertisement on the internet if:
6
(a) the advertisement is accessible by the public, or a section of
7
the public, in a State or Territory; and
8
(b) the advertisement provides a facility for a person accessing
9
the advertisement to purchase a tobacco product; and
10
(c) a law of the State or Territory regulates the advertising of
11
tobacco products on the internet; and
12
(d) that law contains provisions expressly dealing with the
13
publication of advertisements for tobacco products on the
14
internet that provide a facility for a person accessing the
15
advertisement to purchase a tobacco product; and
16
(e) under those provisions, publishing the advertisement is not an
17
offence.

(2) A person may publish a tobacco advertisement on the internet if:
1
(a) the advertisement is accessible by the public, or a section of
2
the public, in a State or Territory; and
3
(b) the advertisement provides a facility for a person accessing
4
the tobacco advertisement to purchase a tobacco product; and
5
(c)
either:
6
(i) there is no law of the State or Territory that regulates
7
the advertising of tobacco products on the internet; or
8
(ii) there is such a law, but it does not contain any
9
provisions expressly dealing with the publication of
10
advertisements for tobacco products on the internet that
11
provide a facility for a person accessing the
12
advertisement to purchase a tobacco product; and
13
(d) the publication of the advertisement complies with all
14
applicable requirements set out in regulations made for the
15
purposes of this subsection.

(3) In this section, a tobacco advertisement provides a facility for a
17
person accessing the advertisement to purchase a tobacco product
18
if the advertisement is published in conjunction with the facility or
19
otherwise includes or provides the facility.
20
(4) Regulations made for the purposes of subsection (2) may prescribe
21
requirements as to any of the following:
22
(a) the size, content, format and location of tobacco
23
advertisements;
24
(b) without limiting paragraph (a)--the inclusion in tobacco
25
advertisements of any of the following:
26
(i)
health
warnings;
27
(ii) warnings about age restrictions on the sale of tobacco
28
products;
29
(iii) information about any fees, taxes and charges payable in
30
relation to tobacco products;
31
(c) age restricted access systems for access to tobacco
32
advertisements.

16B Conduct by carriers etc. permitted
34
(1) A person may publish a tobacco advertisement if:

(a) the person is a carrier and, in publishing the tobacco

advertisement, is acting solely in the person's capacity as a
2
carrier; or
3
(b) the person is a carriage service provider and, in publishing
4
the tobacco advertisement, is acting solely in the person's
5
capacity as a carriage service provider; or
6
(c) the person is an internet service provider and, in publishing
7
the tobacco advertisement, is acting solely in the person's
8
capacity as an internet service provider; or
9
(d) the person is an internet content host and, in publishing the
10
tobacco advertisement, is acting solely in the person's
11
capacity as an internet content host.

(2) In this section:
13
carriage service provider has the same meaning as in the
14
Telecommunications Act 1997.
15
carrier has the same meaning as in the Telecommunications Act
16
1997.
17
internet content host has the same meaning as in Schedule 5 to the
18
Broadcasting Services Act 1992.
19
internet service provider has the same meaning as in Schedule 5 to
20
the Broadcasting Services Act 1992.

16 Publication of a tobacco advertisement before
2
commencement

(1)
This item applies if a tobacco advertisement was published
4
electronically (within the meaning of the Tobacco Advertising
5
Prohibition Act 1992 as amended by Part 1 of this Act) before the
6
commencement of Part 1 of this Act.
7
(2) The
Tobacco Advertising Prohibition Act 1992, as amended by Part 1 of
8
this Act, applies in relation to the publication of the tobacco
9
advertisement if the tobacco advertisement is accessible by the public,
10
or a section of the public, at or after the commencement of Part 1 of this
11
Act.
