A Bill for an Act to amend the Privacy Act 1988 to remove the exemption provided by the Act for political acts and practices, and for related purposes

The Parliament of Australia enacts:

1  Short title

This Act may be cited as the Privacy (Extension to Political Acts and Practices) Amendment Act 2006.

2  Commencement

This Act commences on the day on which it receives the Royal Assent.

3  Objects

The object of this Act is to ensure registered political parties are included in and subject to the Privacy Act 1988, and to prevent the uncontrolled and unauthorised use of personal information by registered political parties and their members.

4  Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

 

Schedule 1--Amendment of the Privacy Act 1988

1  After paragraph 6C(1)(e) (definition of organisation)

Insert:

or (f) a registered political party;

2  Subsection 6C(1) (definition of organisation)

Omit "a registered political party,".

3  Section 7C

Repeal the section.
