The Parliament of Australia enacts:

Part 1--Preliminary

1 Short title
7
This Act may be cited as the Protecting Problem Gamblers Act
8
2009.

Section 2

2 Commencement
1
This Act commences at the end of 6 months after the day on which
2
it receives the Royal Assent.

3 Objects of Act
4
The object of this Act is to protect problem gamblers by reducing
5
bet limits to $1 per spin and load up limits to $20.

4 Application of Act

Extension to external Territories
8
(1) This Act extends to Norfolk Island, the Territory of Cocos
9
(Keeling) Islands and the Territory of Christmas Island.

Limited extraterritorial application
11
(2) This Act applies to acts, omissions, matters and things in the
12
Australian jurisdiction, and subject to subsection (3), does not
13
apply to acts, omissions, matters and things outside the Australian
14
jurisdiction.

Application outside exclusive economic zone limited to Australian
16
vessels
17
(3) A provision of this Act that has effect outside the outer limits of
18
the exclusive economic zone and the continental shelf applies only
19
in relation to Australian vessels.

Application to vessels in the Australian jurisdiction inside
21
exclusive economic zone
22
(4) A provision of this Act that has effect within the outer limits of the
23
exclusive economic zone (whether in the zone or in Australia or an
24
external Territory) or on or in the continental shelf applies in
25
relation to all vessels (including vessels that are not Australian
26
vessels).

5 Relationship with State and Territory law

This Act is not intended to exclude or limit the concurrent
5
operation of any law of a State or Territory, unless the contrary
6
intention appears.

6 Definitions
8
In this Act:
9
accumulated credits means the credits registered on any single
10
poker machine to the benefit of a player, whether credited to the
11
machine by a player entering credits or accumulated through
12
playing the machine.
13
Australian jurisdiction means the land, waters, seabed and
14
airspace in, under or above:
15
(a)
Australia;
or
16
(b) an external Territory; or
17
(c) the exclusive economic zone; or
18
(d) the continental shelf.

Note:
A reference to Australia or to an external Territory generally includes
20
a reference to the coastal sea of Australia or the Territory (as
21
appropriate). See section 15B of the Acts Interpretation Act 1901.

Australian vessel means:
23
(a) a vessel that is owned, possessed or controlled by:
24
(i) the Commonwealth or a Commonwealth agency; or
25
(ii) a State, a self-governing Territory or an agency of a
26
State or self-governing Territory; or
27
(b) a vessel that is registered in Australia; or
28
(c) a vessel that is flying the Australian flag.

corporation means a body corporate that:
30
(a) is a foreign corporation; or

(b) is a trading corporation formed within the limits of Australia
1
or is a financial corporation so formed; or
2
(c) is incorporated in a Territory; or
3
(d) is the holding company of a body corporate of a kind referred
4
to in paragraph (a), (b) or (c).

entering credits: a player enters credits into a poker machine by:
6
(a) inserting coins or bank notes;
7
(b) inserting a token, voucher or ticket that represents an amount
8
of money or has been purchased for an amount of money;
9
(c) undertaking an electronic transfer of an amount of money;
10
into the machine, or other equipment linked to the machine, to
11
increase the amount or value of accumulated credits.

executive officer of a body corporate means a person who is
13
concerned in, or takes part in, the management of the body
14
corporate.
15
game, in relation to a gaming machine or a poker machine, means
16
a play, or a series of plays, initiated by the application of a
17
monetary credit registered on the machine.
18
gaming machine has the same meaning as poker machine.
19
play has the meaning given by section 7.
20
poker machine means a machine:
21
(a) designed for playing a game of chance, or of mixed chance
22
and skill; and
23
(b) designed to be played completely or partly by:
24
(i) the insertion of one or more coins, notes or tokens; or
25
(ii) the application of a monetary credit registered on the
26
machine or elsewhere; and
27
(c) that offers, or that appears to offer, people a chance to win
28
monetary or other valuable consideration by playing the
29
machine.

spin means a sequence of actions and states in a gaming machine
31
or a poker machine initiated by a player through wagering a single
32
credit and terminated when the credit wagered has been lost or all

winnings have been transferred to the total wins meter of the
1
gaming machine or poker machine and the player's credit meter.

total wins meter means a device for recording amounts that, if won
3
by a player, would be credited to the credit meter of the player's
4
gaming machine or poker machine.

7 Meaning of play
6
For the purposes of this Act, a person is taken to play a gaming
7
machine or a poker machine if the person, directly or indirectly:
8
(a) inserts a coin, note, gaming token or smart card into the
9
machine; or
10
(b) causes gaming machine credits to be registered by the
11
machine; or
12
(c) makes a bet on the machine; or
13
(d) causes the activation of any process relating to the game of
14
the machine; or
15
(e) makes or participates in the making of the decisions involved
16
in playing the machine.

8 Application

This Part applies to:
6
(a) any corporation that manufactures gaming machines or poker
7
machines for use in the Australian jurisdiction, an external
8
Territory, on an Australian vessel or on a vessel that is not an
9
Australian vessel but which navigates in the Australian
10
jurisdiction; and
11
(b) any corporation that sells, offers or exposes for sale or
12
supplies gaming machines or poker machines for use in the
13
Australian jurisdiction, an external Territory, on an
14
Australian vessel or on a vessel that is not an Australian
15
vessel but which navigates in the Australian jurisdiction,
16
whether those machines are manufactured within the
17
Australian jurisdiction or not.

9 Maximum credit that may be entered
19
(1) A corporation must not manufacture a gaming machine or a poker
20
machine that allows a player to enter:
21
(a) a banknote with a denomination greater than $20; or
22
(b) a credit of an amount greater than $20 by any other means in
23
a single transaction.
24
Maximum civil penalty:
2,000 penalty units.

penalty unit has the meaning given by section 4AA of the Crimes Act

1914.

(2) A corporation must not sell, offer or expose for sale or supply a
28
gaming machine or a poker machine that allows a player to enter:
29
(a) a banknote with a denomination greater than $20; or
30
(b) a credit of an amount greater than $20 by any other means in
31
a single transaction.

10 Limit on when credits may be entered
4
(1) A corporation must not manufacture a gaming machine or a poker
5
machine that allows a player to enter credits into the machine if the
6
amount or value of accumulated credits in the machine is greater
7
than $20.
8
Maximum civil penalty:
2,000 penalty units.

(2) A corporation must not sell, offer or expose for sale or supply a
12
gaming machine or a poker machine that allows a player to enter
13
credits into the machine if the amount or value of accumulated
14
credits in the machine is greater than $20.

(3) This section does not apply in relation to credits accumulated on a
19
gaming machine or a poker machine through the player playing
20
that machine.

11 Maximum bet per spin
22
(1) A corporation must not manufacture a gaming machine or a poker
23
machine that enables a maximum bet greater than $1 per spin.
24
Maximum civil penalty:
2,000 penalty units.

(2) A corporation must not sell, offer or expose for sale or supply a
28
gaming machine or a poker machine that enables a maximum bet
29
greater than $1 per spin.
30
Maximum civil penalty:
2,000 penalty units.

12 Federal Court may order person to pay pecuniary penalty for
3
contravening civil penalty provision
4
Application for order
5
(1) Within 6 years of a person (the wrongdoer) contravening a civil
6
penalty provision, the Minister may apply on behalf of the
7
Commonwealth to the Federal Court for an order that the
8
wrongdoer pay the Commonwealth a pecuniary penalty.
9
Court may order wrongdoer to pay pecuniary penalty
10
(2) If the Court is satisfied that the wrongdoer has contravened a civil
11
penalty provision, the Court may order the wrongdoer to pay to the
12
Commonwealth for each contravention the pecuniary penalty that
13
the Court determines is appropriate (but not more than the relevant
14
amount specified for the provision).

Determining amount of pecuniary penalty
16
(3) In determining the pecuniary penalty, the Court must have regard
17
to all relevant matters, including:
18
(a) the nature and extent of the contravention; and
19
(b) the circumstances in which the contravention took place; and
20
(c) whether the person has previously been found by the Court in
21
proceedings under this Act to have engaged in any similar
22
conduct.

Conduct contravening more than one civil penalty provision
24
(4) If conduct constitutes a contravention of two or more civil penalty
25
provisions, proceedings may be instituted under this Act against a
26
person in relation to the contravention of any one or more of those
27
provisions. However, the person is not liable to more than one
28
pecuniary penalty under this section in respect of the same
29
conduct.

13 What is a civil penalty provision?

A subsection of this Act (or a section of this Act that is not divided
2
into subsections) is a civil penalty provision if the words "civil
3
penalty" and an amount in penalty units is set out at the foot of the
4
subsection (or section).

14 Contravening a civil penalty provision is not an offence
6
A contravention of a civil penalty provision is not an offence.
7
15 Persons involved in contravening civil penalty provision
8
(1) A person must not:
9
(a) aid, abet, counsel or procure a contravention of a civil
10
penalty provision; or
11
(b) induce (by threats, promises or otherwise) a contravention of
12
a civil penalty provision; or
13
(c) be in any way directly or indirectly knowingly concerned in,
14
or party to, a contravention of a civil penalty provision; or
15
(d) conspire to contravene a civil penalty provision.
16
(2) This Division applies to a person who contravenes subsection (1)
17
in relation to a civil penalty provision as if the person had
18
contravened the provision.
19
16 Recovery of a pecuniary penalty
20
If the Federal Court orders a person to pay a pecuniary penalty:
21
(a) the penalty is payable to the Commonwealth; and
22
(b) the Commonwealth may enforce the order as if it were a
23
judgment of the Court.

17 Acceptance of undertakings relating to contraventions of civil

penalty provisions

(1) This section applies if the Minister considers that an action taken
5
by a body corporate after the commencement of this section
6
contravened one or more civil penalty provisions of Part 2.
7
(2) The Minister may accept a written undertaking given by an
8
executive officer on behalf of the body corporate in relation to the
9
action, in which the body corporate:
10
(a) undertakes to pay a specified amount, within a specified
11
period to the Commonwealth; or
12
(b) any other undertaking in connection with that contravention.
13
(3) The executive officer on behalf of the body corporate may
14
withdraw or vary the undertaking at any time, but only with the
15
consent of the Minister.

18 Enforcement of undertakings
17
(1) If the Minister considers that an executive officer who gave an
18
undertaking under section 17 or the body corporate on behalf of
19
which an undertaking was given under section 17 has breached any
20
of its terms, the Minister may apply to the Federal Court for an
21
order under subsection (2).
22
(2) If the Federal Court is satisfied that the executive officer or the
23
body corporate has breached a term of the undertaking, the Court
24
may make one or more of the following orders:
25
(a) an order directing the executive officer or the body corporate
26
to comply with that term of the undertaking;
27
(b) any other order that the Court considers appropriate.

18 Regulations

The Governor-General may make regulations prescribing matters:
3
(a) required or permitted by this Act to be prescribed; or
4
(b) necessary or convenient to be prescribed for carrying out or
5
giving effect to this Act.
