   The Parliament of Australia enacts:

      1 Short title

   This Act may be cited as the Primary Industries and Energy Research and
   Development Amendment Act 2001.

      2 Commencement

   This Act commences, or is taken to have commenced, on 1 July 2001.

      3 Schedule(s)

   Each Act that is specified in a Schedule to this Act is amended or
   repealed as set out in the applicable items in the Schedule concerned,
   and any other item in a Schedule to this Act has effect according to
   its terms.

        Schedule 1--Primary Industries and Energy Research and Development Act
        1989

   1 Subsection 31(1)

   Omit "Subject to subsection (4), where:", substitute "If:".

   2 Subsection 31(4)

   Repeal the subsection.

   3 Saving

   The amendments of section 31 of the Primary Industries and Energy
   Research and Development Act 1989 by this Schedule do not increase the
   amount that an R&D Corporation established in respect of forest
   industries is entitled to be paid under paragraph 30(1)(b) of that Act
   on the basis of amounts paid to the Corporation under subparagraphs
   30(1)(a)(i) and (ii) of that Act before 1 July 2001.

   4 Subsection 32(1)

   Omit "subsections (3) and (4),", substitute "subsection (3),".

   5 Subsection 32(4)

   Repeal the subsection.

   6 Application

   The amendments of section 32 of the Primary Industries and Energy
   Research and Development Act 1989 by this Schedule apply to each
   financial year starting on or after 1 July 2001.
