Information in this column may be added to or 6 edited in any published version of this Act. 7 3 Schedule(s) 8 Each Act that is specified in a Schedule to this Act is amended or 9 repealed as set out in the applicable items in the Schedule 10 concerned, and any other item in a Schedule to this Act has effect 11 according to its terms. 12 2 Offshore Petroleum and Greenhouse Gas Storage (Safety Levies) Amendment Bill 2009 No. , 2009 [Page Break] Safety case levy Part 1 1 2 Schedule 1--Amendments 3 Part 1--Safety case levy 4 Offshore Petroleum and Greenhouse Gas Storage (Safety 5 Levies) Act 2003 6 1 Subsection 7(3) 7 Repeal the subsection, substitute: 8 (3) Safety case levy imposed by subsection (1) is payable by: 9 (a) if the facility is a pipeline subject to a pipeline licence--the 10 licensee of the pipeline licence; or 11 (b) otherwise--the operator of the facility. 12 Note: For collection of safety case levy, see section 687 of the Offshore 13 Petroleum and Greenhouse Gas Storage Act 2006. 14 2 Subsection 7(8) 15 Insert: 16 pipeline has the same meaning as in the Offshore Petroleum and 17 Greenhouse Gas Storage Act 2006, and includes a pipeline that is: 18 (a) proposed to be constructed or operated; or 19 (b) being constructed. 20 3 Subsection 7(8) 21 Insert: 22 pipeline licence has the same meaning as in the Offshore 23 Petroleum and Greenhouse Gas Storage Act 2006. 24 4 Subsection 8(3) 25 Repeal the subsection, substitute: 26 (3) Safety case levy imposed by subsection (1) is payable by: 27 (a) if the facility is a pipeline subject to a pipeline licence--the 28 licensee of the pipeline licence; or 29 (b) otherwise--the operator of the facility.
