The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Medical Indemnity Legislation
6
Amendment (Competitive Neutrality) Act 2005.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

Subdivision B--Who pays competitive advantage payment

59B Who is liable to pay the competitive advantage payment
2
A person is liable to pay a competitive advantage payment for a
3
financial year if:
4
(a) the person is a medical indemnity insurer; and
5
(b) the financial year is a contribution year; and
6
(c) the person is not exempt from the payment under
7
section 59C.

59C Exemptions
9
(1) The regulations may provide that a person is exempt from
10
competitive advantage payment in the circumstances specified in
11
the regulations.
12
(2) Regulations made for the purposes of subsection (1) may provide
13
that a person is exempt from competitive advantage payment either
14
generally or for a particular contribution year.

Subdivision C--Annual reassessment of participating MDO's
16
net IBNR exposure
17
59D Object of this Subdivision
18
The object of this Subdivision is to allow annual reassessment and
19
publication of a participating MDO's net IBNR exposure so that
20
the competitive advantage payment reflects the competitive
21
advantage that the participating MDO and any associated insurer
22
enjoy.

59E Process for annually reassessing net IBNR exposure
24
Report by the Actuary
25
(1) For each contribution year for a participating MDO, the Actuary
26
must give the Minister a written report that:
27
(a) states the Actuary's assessment of the MDO's net IBNR
28
exposure as at the end of the financial year that ends
29
immediately before the start of that contribution year; and

(b) sets out the reasons for the assessment.

(2) In preparing the report, the Actuary must take into account any
2
information that the HIC gives the Actuary in relation to the MDO
3
under subsection (6).

HIC's information gathering powers
5
(3) If the HIC believes on reasonable grounds that a participating
6
MDO is capable of giving information that is relevant to assessing
7
the MDO's net IBNR exposure as at the end of a financial year that
8
ends immediately before the start of a contribution year for the
9
MDO, the HIC may request the MDO to give the HIC the
10
information.
11
Note:
Failure to comply with the request is an offence (see section 73).
12
(4) Without limiting subsection (3), the kind of information that may
13
be requested includes information in the form of:
14
(a) financial statements; and
15
(b) a report prepared by a suitably qualified actuary assessing the
16
MDO's net IBNR exposure as at the end of a financial year
17
that ends immediately before the start of a contribution year
18
for the MDO.

(5) The request:
20
(a) must be made in writing; and
21
(b) must state what information the MDO is to give to the HIC;
22
and
23
(c) may require the information to be verified by statutory
24
declaration; and
25
(d) must specify the day on or before which the information must
26
be given; and
27
(e) must contain a statement to the effect that a failure to comply
28
with the request is an offence.
29
The day specified under paragraph (d) must be at least 28 days
30
after the day on which the request is made.
31
(6) The HIC must give any information that the MDO gives the HIC to
32
the Actuary for the purposes of preparing the report for the
33
Minister under subsection (1).

Publishing net IBNR exposure
1
(7) The Minister must cause to be published in the Gazette a notice of
2
the amount of any net IBNR exposure of an MDO stated in a report
3
to the Minister under subsection (1).

(8) A notice made under subsection (7) is not a legislative instrument.
