   Development Services Act 2000, and for related purposes

   The Parliament of Australia enacts:

      1 Short title

   This Act may be cited as the Horticulture Marketing and Research and
   Development Services (Amendment) Act 2002.

      2 Commencement

   This Act commences on the day on which it receives the Royal Assent.

      3 Schedule(s)

   Each Act that is specified in a Schedule to this Act is amended or
   repealed as set out in the applicable items in the Schedule concerned,
   and any other item in a Schedule to this Act has effect according to
   its terms.

        Schedule 1--Amendment of the Horticulture Marketing and Research and
        Development Services Act 2000

   1 After section 26

   Insert:

      26A Access to customs information

   Horticulture Australia Limited, in its capacity as the industry export
   control body, is taken to be a Commonwealth agency for the purposes of
   section 16 of the Customs Administration Act 1985.

   Note: Section 16 of the Customs Administration Act 1985 allows the
   Australian Customs Service to disclose information to Commonwealth
   agencies in certain circumstances.
