The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Higher Education Support
5
Amendment Act (No. 2) 2011.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

Despite the repeal of section 30-5 of the Higher Education Support Act

2003, that section continues to apply in respect of 2011 as if the

has effect continues to apply for the purposes of subitem (1).

Meaning of HECS-HELP discount

The
HECS-HELP discount for a unit of study is an amount equal
2
to one-ninth of the sum of all of the
*
up-front payments made for
3
the unit.

Example: Robert is required to pay a student contribution amount of $2,745 by
5
31 January 2012, and makes an up-front payment of $900 on
6
20 January 2012.
7
Robert is entitled to HECS-HELP assistance of $1,845 ($2,745 minus
8
$900), which the Commonwealth must pay to the higher education
9
provider.
10
The up-front payment exceeded $500 so there is a HECS-HELP
11
discount of $100 (one-ninth of $900). The Commonwealth lends to
12
Robert the remainder of the HECS-HELP assistance, an amount of
13
$1,745 ($1,845 minus $100).

Example: Lorraine is studying part-time for a Degree of Bachelor of

Communications. On 1 June 2011, Lorraine had an accumulated
7
HELP debt of $15,000. She incurred a HELP debt of $1,500 on
8
31 March 2011. She made a voluntary repayment of $525 (which
9
includes a voluntary repayment bonus of $25) on 1 May 2012.
10
Lorraine lodged her 2010-11 income tax return and a compulsory
11
repayment amount of $3,000 was assessed and notified on her income
12
tax notice of assessment on 3 September 2011.

To work out Lorraine's former accumulated HELP debt before
14
indexation on 1 June 2012:

Step 1:
Take the previous accumulated HELP debt of $15,000 on 1 June 2011.

Step 2:
Add the HELP debt of $1,500 incurred on 31 March 2011.

4 Application provision

The amendments made by this Schedule apply in relation to payments
20
made under Division 151 of the Higher Education Support Act 2003 on
21
or after the commencement of this Schedule to meet a person's debts to
22
the Commonwealth under Chapter 4 of that Act.

9 Transitional provisions

Advice as to whether person is Commonwealth supported

student

(1)
The amendment made by item 1 of this Schedule does not apply in
19
relation to a unit of study (the proposed unit of study) that is, or is to be,
20
undertaken by a person if:
21
(a) the proposed unit of study contributes to the requirements of
22
a course of study (the current course of study); and
23
(b) the person started the current course of study before the
24
commencement of this Schedule; and
25
(c) before that commencement, the person was a Commonwealth
26
supported student in relation to another unit of study that
27
contributed to the requirements of the current course of
28
study; and
29
(d) the person would not have been a Commonwealth supported
30
student in relation to that other unit of study if the
31
amendment made by item 1 of this Schedule had applied in
32
relation to that other unit of study and the person; and

(e) the census date for the proposed unit of study is on or after

the commencement of this Schedule.

HECS-HELP assistance

(2)
The amendments made by items 1, 2 and 3 of this Schedule do not
4
apply in relation to a unit of study (the proposed unit of study) in which
5
a student is enrolled with a higher education provider as part of a course
6
of study (the current course of study) if:
7
(a) the student started the current course of study before the
8
commencement of this Schedule; and
9
(b) before that commencement, the student was a
10
Commonwealth supported student in relation to another unit
11
of study that forms part of the current course of study; and
12
(c) the student would not have been a Commonwealth supported
13
student in relation to that other unit of study if the
14
amendments made by items 1, 2 and 3 of this Schedule had
15
applied in relation to that other unit of study and the student;
16
and
17
(d) the census date for the proposed unit of study is on or after
18
the commencement of this Schedule.

FEE-HELP assistance

(3)
The amendments made by items 4 and 5 of this Schedule do not apply
21
in relation to a unit of study (the proposed unit of study) that is, or is to
22
be, undertaken by a student as part of a course of study (the current
23
course of study) if:
24
(a) the student started the current course of study before the
25
commencement of this Schedule; and
26
(b) before that commencement, the student received an amount
27
of FEE-HELP assistance for another unit of study that forms
28
part of the current course of study; and
29
(c) the student would not have received an amount of
30
FEE-HELP assistance for that other unit of study if the
31
amendments made by items 4 and 5 of this Schedule had
32
applied in relation to the unit of study and the student; and
33
(d) the census date for the proposed unit of study is on or after
34
the commencement of this Schedule.

VET FEE-HELP assistance

The amendments made by items 6 and 7 of this Schedule do not apply

in relation to a VET unit of study (the proposed VET unit of study) that

is, or is to be, undertaken by a student as part of a VET course of study
4
(the current VET course of study) if:
5
(a) the student started the current VET course of study before the
6
commencement of this Schedule; and
7
(b) before that commencement, the student received an amount
8
of VET FEE-HELP assistance for another VET unit of study
9
that forms part of the current VET course of study; and
10
(c) the student would not have received an amount of VET
11
FEE-HELP assistance for that other VET unit of study if the
12
amendments made by items 6 and 7 of this Schedule had
13
applied in relation to the VET unit of study and the student;
14
and
15
(d) the census date for the proposed VET unit of study is on or
16
after the commencement of this Schedule.
