 3   The Parliament of Australia enacts:
 4   1 Short title
 5              This Act may be cited as the Higher Education Support
 6              Amendment Act 2009.

 7   2 Commence ment
 8              This Act commences on the day on which it receives the Royal
 9              Assent.

10   3 Schedule(s)
11              Each Act that is specified in a Schedule to this Act is amended or
12              repealed as set out in the applicable items in the Schedule

 1   Schedule 1--Amendments

 3   Higher Education Support Act 2003
 4   1 Paragraph 16-25(c)
 5        Omit "fulfilled the * tuition assurance requirements on the date of
 6        making an application under section 16-40", substitute "fulfils the
 7        * tuition assurance requirements".


 8   2 Paragraph 6(d) of Schedule 1A
 9        Omit "fulfilled the * VET tuition assurance requirements on the date of
10        making an application under clause 9", substitute "fulfils the * VET
11        tuition assurance requirements".

12   3 Subclause 11(2) of Schedule 1A
13        Repeal the subclause, substitute:
14         (2) For the purposes of paragraph 6(f):
15              (a) the Minister may be satisfied that a body corporate is willing
16                   and able to meet the * VET quality and accountability
17                   requirements if the body gives the Minister such written
18                   undertakings as the Minister requires; and
19              (b) the Minister may be satisfied that a body corporate is willing
20                   and able to meet:
21                     (i) the * VET quality and accountability requirements; or
22                    (ii) one or more of the requirements referred to in
23                         paragraphs 13(1)(a) to (f);
24                   if a body approved under the * VET Provider Guidelines so
25                   recommends in accordance with those guidelines.
26       (2A) Subclause (2) does not limit the circumstances in which the
27            Minister may be satisfied, for the purposes of paragraph 6(f), that a
28            body corporate is willing and able to meet the * VET quality and
29            accountability requirements.
