A Bill for an Act to amend the Flags Act 1953 to recognise the Eureka Flag as an official flag of Australia, and for related purposes

The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Flags Amendment (Eureka Flag) Act 2003.

2 Commencement

This Act commences on the day on which it receives the Royal Assent.

3 Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1—Amendment of the Flags Act 1953

1 After section 4

Insert:

4A The Eureka Flag

The flag described in Schedule 3, being the flag a reproduction of which is set out in Schedule 4, shall be known as the Eureka Flag or the Southern Cross Flag.

2 After Schedule 2

Insert:

Schedule 3 - The Eureka Flag

1. The Eureka Flag or Southern Cross Flag is a blue flag and has:

a) the proportion of 13:20 (width:length);

b) a white cross in the centre of the flag, each arm of the cross not extending to the edge of the flag as specified in Table C;

c) an eight pointed white star centred over the ends of each arm of the cross as specified in Table D;

d) a larger eight pointed star over the centre of the cross as specified in Table D;

e) each star with a blue border in the same colour as the background.
