The Parliament of Australia enacts:

1 Short title
6
This Act may be cited as the Carbon Pollution Reduction Scheme
7
Amendment (Household Assistance) Act 2009.

2 Commencement
9
(1) Each provision of this Act specified in column 1 of the table
10
commences, or is taken to have commenced, in accordance with
11
column 2 of the table. Any other statement in column 2 has effect
12
according to its terms.

(1) The main object of this Division is to increase certain amounts that
16
affect the rate at which social security payments are made to
17
certain recipients of payments of the following kinds, on account
18
of the Carbon Pollution Reduction Scheme's estimated cost of
19
living increase:

(a)
age
pension;
21
(b)
austudy
payment;
22
(c)
bereavement
allowance;
23
(d)
carer
payment;
24
(e) disability support pension;
25
(f)
newstart
allowance;
26
(g)
parenting
payment;
27
(h)
partner
allowance;
28
(i)
sickness
allowance;
29
(j)
widow
allowance;

(2) Another object of this Division is to adjust indexation of those

amounts after they are increased, to reflect the inclusion in the

increases of elements brought forward from the Carbon Pollution

Reduction Scheme's estimated cost of living increase.

This Subdivision applies to the following amounts (each of which

is a base amount):

(a) amounts provided for in a provision that is listed in column 1

of the following table and sets a rate;

1206GH Increase of 1% on 1 July 2011
4
This Act has effect as if, on 1 July 2011, each base amount were
5
replaced by an amount (the replacement amount) worked out by:
6
(a) calculating the amount (the provisional replacement
7
amount) that is 1% greater than the base amount; and
8
(b) if the provisional replacement amount is not a multiple of the
9
rounding base for the base amount, rounding up or down to
10
the nearest multiple of the rounding base (rounding up if the
11
provisional replacement amount is not a multiple of the
12
rounding base but is a multiple of half the rounding base).

Note:
The 1% increase includes the Carbon Pollution Reduction Scheme's
14
estimated cost of living increase of 0.4% for the 2011-2012 financial
15
year, which has been brought forward. The change to the indexation
16

factor on or after 20 March 2012 under section 1206GJ takes account
1
of this brought forward increase.

1206GI Increase of 1.8% on 1 July 2012

This Act has effect as if, on 1 July 2012, the base amount were
4
replaced by an amount (the replacement amount) worked out by:
5
(a) calculating the amount (the provisional replacement
6
amount) that is 1.8% greater than the base amount; and
7
(b) if the provisional replacement amount is not a multiple of the
8
rounding base for the base amount, rounding up or down to
9
the nearest multiple of the rounding base (rounding up if the
10
provisional replacement amount is not a multiple of the
11
rounding base but is a multiple of half the rounding base).

Note:
The 1.8% increase includes the Carbon Pollution Reduction Scheme's
13
estimated cost of living increase of 0.8% for the 2012-2013 financial
14
year, which has also been brought forward. The change to the
15
indexation factor on or after 20 March 2013 under section 1206GK
16
takes account of this second brought forward increase.

Subdivision C--Adjustment of indexation
18
1206GJ Special rules for indexation of some amounts on or after
19
20 March 2012
20
(1) An indexation factor worked out under section 1193 for each
21
indexation day that is:
22
(a) for AP MBR and YA MBR--on or after 1 January 2013; or
23
(b) for any other base amount to which Subdivision B applies--
24
on or after 20 March 2012;
25
is to be reduced by the brought forward indexation amount, but not
26
below 1.
27
(2) In this section:
28
brought forward indexation amount, in relation to a day, means
29
0.004 less any reduction made under this section for a previous
30
day.

Note:
Once the brought forward indexation amount becomes zero, there will
32
be no further reduction of the factor.
33
Example: Assume that the indexation factor worked out under section 1193 on
34
20 March 2012 is 1.003. The brought forward indexation amount in
35

relation to 20 March 2012 is 0.004 (as there has been no previous

reduction). That indexation factor is reduced to 1 on 20 March 2012.

Further assume that on 20 September 2012 the indexation factor is
3
1.010. The brought forward indexation amount in relation to
4
20 September 2012 is 0.001. That indexation factor is reduced to
5
1.009 on 20 September 2012.
6
The brought forward indexation amount in relation to later indexation
7
days is now zero so there is no further reduction of the indexation
8
factor.

(3) This section affects the rate of a social security payment for a
10
person if, and only if, section 1206GH affected that rate for the
11
person.

1206GK Special rules for indexation of some amounts on or after
13
20 March 2013
14
(1) An indexation factor worked out under section 1193 for each
15
indexation day that is:
16
(a) for AP MBR and YA MBR--on or after 1 January 2014; or
17
(b) for any other base amount to which Subdivision B applies--
18
on or after 20 March 2013;
19
is to be reduced by the brought forward indexation amount, but not
20
below 1.
21
(2) In this section:
22
brought forward indexation amount, in relation to a day, means
23
0.008 less any reduction made under this section for a previous
24
day.

Note:
Once the brought forward indexation amount becomes zero, there will
26
be no further reduction of the factor.

Example: Assume that the indexation factor worked out under section 1193 on
28
20 March 2013 is 1.005. The brought forward indexation amount in
29
relation to 20 March 2013 is 0.008 (as there has been no previous
30
reduction). That indexation factor is reduced to 1 on 20 March 2013.

Further assume that on 20 September 2013 the indexation factor is
32
1.010. The brought forward indexation amount in relation to
33
20 September 2013 is 0.003. That indexation factor is reduced to
34
1.007 on 20 September 2013.

The brought forward indexation amount in relation to later indexation
36
days is now zero so there is no further reduction of the indexation
37
factor.

(3) This section affects the rate of a social security payment for a
1
person if, and only if, section 1206GI affected that rate for the
2
person.

Subdivision D--Other provision for increases and adjustments
4
of indexation
5
1206GL Minister may provide for increases and adjustments
6
(1) The Minister may, by legislative instrument, provide for:
7
(a) increasing on 1 July 2011 and 1 July 2012 amounts that
8
affect the rates at which any of the following social security
9
payments are paid to recipients:
10
(i)
age
pension;
11
(ii)
bereavement
allowance;
12
(iii)
carer
payment;
13
(iv) disability support pension;
14
(v)
parenting
payment;
15
(vi) widow B pension;
16
(vii)
wife
pension;
17
(viii) payments of kinds specified under section 1206GM;
18
on account of the Carbon Pollution Reduction Scheme's
19
estimated cost of living increase; and
20
(b) changing the indexation under this Act after either or both of
21
those days of amounts that affect the rates at which any of the
22
payments described in paragraph (a) are paid to recipients of
23
payments increased as a result of that paragraph, to reflect
24
any inclusion in the increases of elements brought forward
25
from the Carbon Pollution Reduction Scheme's estimated
26
cost of living increase.
27
(2) The instrument has effect according to its terms, despite any other
28
provision of this Act.
29
(3) To avoid doubt, the instrument may provide for increasing an
30
amount affecting the rate of a payment described in
31
paragraph (1)(a) by an amount or percentage worked out by
32
reference to either or both of the following:
33
(a) the amount to be increased;

(b) another amount affecting the rate at which the same or a
1
different kind of payment is made.

(4) To avoid doubt, the instrument may provide for changing the
3
indexation of an amount that affects the rate of a payment (the
4
affected payment) described in paragraph (1)(a), whether or not
5
that amount, or an amount affecting that payment, was increased as
6
a result of that paragraph, as long as the recipient of the affected
7
payment received a payment that was increased as a result of that
8
paragraph.
9
(5) Subsections (3) and (4) do not limit subsection (1).

Subdivision E--Extending scope of this Division
11
1206GM Other kinds of payments affected by this Division
12
(1) The Minister may, by legislative instrument, specify kinds of social
13
security payments in relation to which this Division applies.
14
Note:
For specification by class, see subsection 13(3) of the Legislative
15
Instruments Act 2003.

(2) Kinds of payments may be specified by reference to either or both
17
of the following:
18
(a) the persons to whom the payments are to be made;
19
(b) the circumstances in which the payments are to be made.
20
(3) Subsection (2) does not limit subsection (1).

1206GN Other amounts to which Subdivision B applies
22
(1) The Minister may, by legislative instrument, specify that
23
Subdivision B applies to a specified amount that affects the rate at
24
which a specified kind of social security payment is made.
25
Note 1:
For specification by class, see subsection 13(3) of the Legislative
26
Instruments Act 2003.
27
Note 2:
A specified kind of payment could be a kind of payment specified
28
under section 1206GM.

(2) If the Minister does so, the instrument must also specify a rounding
30
base for the amount for the purposes of sections 1206GH and
31
1206GI.

(3) An amount may be specified by reference to the fact that it affects
1
the rate at which a specified kind of social security payment is
2
made to specified persons or in specified circumstances.
3
(4) An instrument made under subsection (1) may specify that
4
Subdivision B applies to an amount so far as it affects the rate at
5
which a specified kind of social security payment is made to
6
specified persons or in specified circumstances.
7
(5) Subsections (3) and (4) do not limit subsection (1).

(6) An instrument made under subsection (1) has effect according to
9
its terms.

1061ZAAX Availability of payments
13
(1) A carbon pollution reduction transitional payment is available to
14
qualified persons for each of the 2011-12 and 2012-13 income
15
years.
16
(2) A person cannot receive more than one carbon pollution reduction
17
transitional payment for an income year.
18
1061ZAAY When qualified for a payment
19
A person is qualified for a carbon pollution reduction transitional
20
payment for an income year if:
21
(a) the person satisfies each of the following for the year:
22
(i) the income requirement in section 1061ZAAZ;
23
(ii) the excluded payment requirement in
24
section 1061ZAAZA;
25
(iii) the remaining requirements in section 1061ZAAZB; and
26
(b) the person lodges a claim for the payment; and
27
(c) when the person lodges a claim for the payment, the person:

(i) is an Australian resident or a special category visa
1
holder residing in Australia; and
2
(ii) is in Australia; and
3
(iii) is not in gaol or a psychiatric institution.

1061ZAAZ Income requirement
5
(1)
The
person
(the
claimant) satisfies the income requirement for an
6
income year if the claimant's adjusted taxable income for the year
7
is less than:
8
(a) $30,000 if the claimant was not a member of a couple, and
9
did not have a dependent child, at the end of the year; or
10
(b)
$45,000
if:
11
(i) the claimant was a member of a couple at the end of the
12
year; and
13
(ii) neither the claimant, nor the claimant's partner at that
14
time, had a dependent child at that time; or
15
(c) $60,000 if the claimant had a dependent child at the end of
16
the year; or
17
(d) $60,000 if the claimant was a member of a couple at the end
18
of the year, and the claimant's partner at that time had a
19
dependent child at that time.
20
(2) In this section:
21
adjusted taxable income, for a person for an income year, is the
22
sum of:
23
(a) the person's adjusted taxable income (within the meaning of
24
the Family Assistance Act) for the year; and
25
(b) the superannuation benefits (within the meaning of the
26
Income Tax Assessment Act 1997) (if any) received by the
27
person in relation to the income year to the extent to which
28
those benefits are non-assessable non-exempt income (within
29
the meaning of that Act).

1061ZAAZA Excluded payment requirement
31
(1) The claimant satisfies the excluded payment requirement for an
32
income year if:
33
(a) there were at least 13 weeks during the year for which the
34
claimant:

(i) was not entitled to family tax benefit; and
1
(ii) did not receive any of the payments set out in
2
subsection (2); and
3
(b) for the claimant's partner (if any) at the end of the year--
4
there were at least 13 weeks during the year for which the
5
partner:
6
(i) was not entitled to family tax benefit; and
7
(ii) did not receive any of the payments set out in
8
subsection (2).

For the purposes of paragraph (b), it does not matter whether the
10
partner was the claimant's partner for a particular week.
11
(2) The payments are the following:
12
(a) an income support payment (other than income support
13
supplement);
14
(b) a social security payment;
15
(c) a payment under the ABSTUDY Scheme that included an
16
amount identified as living allowance;
17
(d) a payment under Part 5 or 6 of the Farm Household Support
18
Act 1992;
19
(e) a pension under Part II or IV of the Veterans' Entitlements
20
Act 1986;
21
(f) a weekly amount of compensation under Part 2 of Chapter 4,
22
or section 233, of the Military Rehabilitation and
23
Compensation Act;
24
(g) a Special Rate Disability Pension (within the meaning of
25
section 198 of the Military Rehabilitation and Compensation
26
Act);
27
(h) a payment under the Military Rehabilitation and
28
Compensation Act Education and Training Scheme worked
29
out by reference to the maximum basic rate of youth
30
allowance;
31
(i) a payment under the Veterans' Children Education Scheme
32
worked out by reference to the maximum basic rate of youth
33
allowance.

1061ZAAZB Remaining requirements
35
(1) The claimant satisfies the remaining requirements for an income
36
year if:

(a) the claimant was, at all times during the year, an Australian
1
resident or a special category visa holder residing in
2
Australia; and
3
(b) the claimant was in Australia for at least 39 weeks of the
4
year; and
5
(c) the claimant was not subject to a newly arrived resident's
6
waiting period at any time during the year; and
7
(d) the claimant was not a dependent child of another person for
8
more than 25 weeks of the year; and
9
(e) the claimant was not in gaol and/or psychiatric institutions
10
for more than 25 weeks of the year; and
11
(f) no person was eligible for family tax benefit in respect of the
12
claimant in relation to more than 25 weeks of the year; and
13
(g) if the claimant did not have a partner at the end of the year,
14
and the claimant received a rebate of tax for the year under
15
one or more of the following provisions of the Tax Act:
16
(i) section 159J in respect of a dependant included in class
17
1, 2, 5 or 6 of the table in subsection (2) of that section;
18
(ii) section 159L (housekeeper rebate);
19
(iii) section 159N (low income rebate);
20
the sum of the CPRS components for those rebates is less
21
than:
22
(iv) for the 2011-12 income year--$150; or
23
(v) for the 2012-13 income year--$280; and
24
(h)
if:
25
(i) the claimant had a partner at the end of the year; and
26
(ii) the claimant, and/or the claimant's partner, received a
27
rebate of tax for the year under one or more of the
28
provisions mentioned in paragraph (g);
29
the sum of the CPRS components for those rebates is less
30
than:
31
(iii) for the 2011-12 income year--$210; or
32
(iv) for the 2012-13 income year--$385.
33
(2) In this section:
34
CPRS component, for a rebate under a provision of the Tax Act,
35
means the part of the maximum amount of rebate allowable under
36
that provision that corresponds to the increases in that rebate
37

(1) This section applies if:

Deductions from carbon pollution reduction transitional payment

(2) The following provisions have effect:

(a) the Secretary must deduct from the carbon pollution
20
reduction transitional payment the deductible portion of the
21
payment;
22
(b) an amount equal to the deductible portion of the payment is
23
credited to the Special Account;
24
(c) an amount equal to the deductible portion of the payment is
25
credited to the person's income management account.

(3) For the purposes of subsection (2), the deductible portion of a
27
carbon pollution reduction transitional payment is 100% of the
28
amount of the payment.

previous indexation day.

Subdivision D--Other provision for increases and adjustments

198V Minister may provide for increases and adjustments
3
(1) The Minister may, by legislative instrument, provide for:
4
(a) increasing on 1 July 2011 and 1 July 2012 the following
5
amounts on account of the Carbon Pollution Reduction
6
Scheme's estimated cost of living increase:
7
(i) amounts that affect rates at which disability pension is
8
paid, except amounts to which Subdivision B applies;
9
(ii) amounts that affect rates at which pensions payable to
10
war widow/war widower-pensioners or payments of
11
kinds specified under section 198W are paid for a day to
12
war widow/war widower-pensioners;
13
(iii) amounts that affect rates at which service pensions or
14
payments of kinds specified under section 198W are
15
paid for a day to recipients of service pensions; and
16
(b) changing the indexation under this Act, after either or both of
17
1 July 2011 and 1 July 2012, of amounts that affect rates at
18
which any of the payments (including pensions) described in
19
subparagraph (1)(a)(i), (ii) or (iii) are paid to recipients of
20
payments increased as a result of that subparagraph, to reflect
21
any inclusion in the increases of elements brought forward
22
from the Carbon Pollution Reduction Scheme's estimated
23
cost of living increase.
24
(2) The instrument has effect according to its terms, despite any other
25
provision of this Act.
26
(3) To avoid doubt, the instrument may provide for increasing an
27
amount described in paragraph (1)(a) by an amount or percentage
28
worked out by reference to either or both of the following:
29
(a) the amount to be increased;
30
(b) another amount affecting the rate at which the same or a
31
different kind of payment is made.
32
(4) To avoid doubt, the instrument may provide for changing the
33
indexation of an amount that affects the rate of a payment (the
34
affected payment) described in subparagraph (1)(a)(i), (ii) or (iii)
35
(including a pension), whether or not that amount, or an amount
36

(1) For the dollar amount mentioned in subsection 74(1), the

indexation factor, worked out under section 404 for each

indexation year that commences on or after 1 July 2013, is to be

reduced by the brought forward indexation amount, but not below
6
1.

(2) In this section:

brought forward indexation amount, in relation to an indexation
9
year, means 0.008 less any reduction made under this section for a
10
previous indexation year.

Note:
Once the brought forward indexation amount becomes zero, there will
12
be no further reduction of the indexation factor.

Example: Assume that the indexation factor worked out under section 404 on
14
1 July 2013 is 1.005. The brought forward indexation amount in
15
relation to 1 July 2013 is 0.008 (as there has been no previous
16
reduction). That indexation factor is reduced to 1 on 1 July 2013.
17
Further assume that on 1 July 2014 the indexation factor is 1.010. The
18
brought forward indexation amount in relation to 1 July 2014 is 0.003.
19
That indexation factor is reduced to 1.007 on 1 July 2014.

The brought forward indexation amount in relation to later indexation
21
years is now zero so there is no further reduction of the indexation
22
factor.
