A Bill for an Act to amend the Commonwealth Electoral Act 1918 to provide voluntary electoral enrolment for persons who are 16 and 17 years of age, and for related purposes

The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Commonwealth Electoral Amendment (16 and 17 Year Old Voluntary Enrolment) Act 1996.

2 Commencement

This Act commences on the day on which it receives the Royal Assent.

3 Schedules

The Acts specified in the Schedules are amended in accordance with the applicable items in the Schedules, and the other items in the Schedules have effect according to their terms.


Schedule 1—Amendment of the Commonwealth Electoral Act 1918

1 Subsection 4(3)

Omit “age 17”, substitute “age 16 or 17”.

2 Subsection 93(2)

Omit “, (4)”

3 Subsection 93(3)

Omit the subsection, substitute:

(3) An elector:

(a) whose name has been placed on a Roll in pursuance of a claim made under section 100; and

(b) who has not attained 18 years of age on the date fixed for the polling in an election;

shall be taken to be:

(c) enrolled on a Roll; and

(d) entitled to vote at that election.

4 Subsection 93(4)

Repeal the subsection.

5 Section 98

Omit “age 17” (twice occurring), substitute “age 16 or 17”.

6 Paragraph 100(1)(a)

Omit “17 years of age”, substitute “16 or 17 years of age”.

7 Section 101

Omit “age 17” (twice occurring), substitute “age 16 or 17”.

8 Paragraph 120(1)(a)

Omit “age 17”, substitute “age 16 or 17”.

9 Section 342

Omit “age 17”, substitute “age 16 or 17”.

10 Section 343

Omit “age 17”, substitute “age 16 or 17”.
