The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Constitution Alteration (Just Terms)

2010.

2 Commencement

This Act commences on the day on which it receives the Royal
11
Assent.

The Constitution is altered as set out in the Schedule.

1 Subsection 51(xxxi)

Repeal the subsection, substitute:

(xxxi) the acquisition of property from any State or person and any
6
restrictions on the exercise of property rights enjoyed by a State or
7
person in respect of which the Parliament has power to make laws,
8
but only on just terms.

2 After section 115

Insert:

115A Acquisition of property and restrictions on the exercise of
12
property rights under State law
13
A law of a State may not provide for the acquisition of property
14
from, or any restrictions on the exercise of property rights enjoyed
15
by, any person, except on just terms.
