A Bill for an Act to amend the Aged Care Act 1997, and for related purposes

The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Aged Care Amendment Act 2004.

2 Commencement

This Act commences, or is taken to have commenced, on 1 July 2004.

3 Schedule(s)

Each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1—Amendments


Aged Care Act 1997

1 Paragraph 28-1(3)(b)

Repeal the paragraph.

2 Paragraph 57A-2(1)(h)

Omit “imposes a 5 year limit”, substitute “deals with cessation of the provision of care”.

3 Subsections 57A-7(2), (3) and (4)

Repeal the subsections.

Note: The heading to section 57A-7 is replaced with the heading “Accommodation charge not to accrue after provision of care has ceased”.

4 Application of amendments

The amendments made by items 2 and 3 of this Schedule do not apply in relation to a person who first entered any residential care service as a care recipient (other than as a recipient of respite care) before 1 July 2004.
