Appropriation Bill (No. 4) 2009-2010 No. , 2009 1 [Page Break] Section 2 1 2 Commencement 2 This Act commences on the day this Act receives the Royal 3 Assent. 4 3 Definitions 5 In this Act: 6 acquisition has the same meaning as in the GST Act. 7 administered assets and liabilities item means an amount set out in 8 Schedule 2 in relation to an Agency opposite the heading 9 "Administered Assets and Liabilities". 10 administered item means an amount set out in Schedule 2 opposite 11 an outcome for an Agency under the heading "New Administered 12 Expenses". 13 Agency means: 14 (a) an Agency within the meaning of the Financial Management 15 and Accountability Act 1997; or 16 (b) the High Court of Australia. 17 CAC Act body means: 18 (a) a Commonwealth authority within the meaning of the 19 Commonwealth Authorities and Companies Act 1997; or 20 (b) a Commonwealth company within the meaning of the 21 Commonwealth Authorities and Companies Act 1997. 22 CAC Act body payment item means the amount set out in 23 Schedule 2 in relation to a CAC Act body under the heading 24 "Non-operating". 25 Chief Executive has the same meaning as in the Financial 26 Management and Accountability Act 1997. 27 current year means the financial year ending on 30 June 2010. 28 expenditure means payments for expenses, acquiring assets, 29 making loans or paying liabilities. 2 Appropriation Bill (No. 4) 2009-2010 No. , 2009 [Page Break] Section 3 1 Finance Minister means the Minister administering this Act. 2 GST Act means the A New Tax System (Goods and Services Tax) 3 Act 1999, as it applies because of Division 177 of that Act. 4 Note: Under Division 177 of the GST Act, that Act applies notionally to the 5 Commonwealth and Commonwealth entities. They are therefore 6 notionally liable to pay GST, are notionally entitled to input tax 7 credits and notionally have adjustments. 8 GST qualifying amount means: 9 (a) an input tax credit (within the meaning of the GST Act); or 10 (b) a decreasing adjustment (within the meaning of the GST 11 Act). 12 importation has the same meaning as in the GST Act. 13 item means any of the following: 14 (a) a State, ACT, NT and local government item; 15 (b) an administered item; 16 (c) an administered assets and liabilities item; 17 (d) an other departmental item; 18 (e) a CAC Act body payment item. 19 other departmental item means an amount set out in Schedule 2 in 20 relation to an Agency: 21 (a) opposite the heading "Equity Injections"; or 22 (b) opposite the heading "Loans"; or 23 (c) opposite the heading "Previous Years' Outputs". 24 Portfolio Additional Estimates Statements means the Portfolio 25 Additional Estimates Statements that were tabled in the Senate or 26 the House of Representatives in relation to the Bill for this Act and 27 the Bill for the Appropriation Act (No. 3) 2009-2010. 28 Portfolio Budget Statements means the Portfolio Budget 29 Statements that were tabled in the Senate or the House of 30 Representatives in relation to the Bill for the Appropriation Act 31 (No. 1) 2009-2010 and the Bill for the Appropriation Act (No. 2) 32 2009-2010. 33 Portfolio Statements means: Appropriation Bill (No. 4) 2009-2010 No. , 2009 3 [Page Break] Section 4 1 (a) the Portfolio Budget Statements; and 2 (b) the Portfolio Supplementary Estimates Statements; and 3 (c) the Portfolio Additional Estimates Statements. 4 Portfolio Supplementary Estimates Statements means the 5 Portfolio Supplementary Estimates Statements that were tabled in 6 the Senate or the House of Representatives in relation to the Bill 7 for the Appropriation (Water Entitlements and Home Insulation) 8 Act 2009-2010 and the Bill for the Appropriation (Water 9 Entitlements) Act 2009-2010. 10 Special Account has the same meaning as in the Financial 11 Management and Accountability Act 1997. 12 State, ACT, NT and local government item means an amount set 13 out in Schedule 2 opposite an outcome for an Agency under the 14 heading "Payments to States, ACT, NT and local government". 15 4 Portfolio Statements 16 The Portfolio Statements are hereby declared to be relevant 17 documents for the purposes of section 15AB of the Acts 18 Interpretation Act 1901. 19 Note: See paragraph 15AB(2)(g) of the Acts Interpretation Act 1901. 20 5 Notional payments, receipts etc. 21 For the purposes of this Act, notional transactions between 22 Agencies are to be treated as if they were real transactions. 23 Note: This section applies, for example, to a "payment" between Agencies 24 that are both part of the Commonwealth. One of the effects of this 25 section is that the payment will be debited from an appropriation for 26 the paying Agency, even though no payment is actually made from the 27 Consolidated Revenue Fund. 28 4 Appropriation Bill (No. 4) 2009-2010 No. , 2009 [Page Break] Section 6 1 Part 2--Appropriation items 2 3 6 Summary of appropriations 4 The total of the items specified in Schedule 2 is $310,915,000. 5 Note 1: Items in Schedule 2 can be adjusted under Part 3 of this Act. 6 Note 2: Sections 30 to 32 of the Financial Management and Accountability 7 Act 1997 also provide for adjustments of amounts appropriated by this 8 Act. 9 7 State, ACT, NT and local government items 10 (1) The amount specified in a State, ACT, NT and local government 11 item for an outcome for an Agency may be applied for the purpose 12 of making payments to or for the States, the Australian Capital 13 Territory, the Northern Territory and local government authorities 14 for the purpose of contributing to achieving that outcome. 15 Note: The Finance Minister manages the expenditure of public money 16 through the issue of drawing rights under the Financial Management 17 and Accountability Act 1997. 18 (2) If the Portfolio Statements indicate that activities of a particular 19 kind were intended to be treated as activities in respect of a 20 particular outcome, then expenditure for the purpose of carrying 21 out those activities is taken to be expenditure for the purpose of 22 contributing to achieving the outcome. 23 8 Administered items 24 (1) The amount specified in an administered item for an outcome for 25 an Agency may be applied for expenditure for the purpose of 26 contributing to achieving that outcome. 27 Note: The Finance Minister manages the expenditure of public money 28 through the issue of drawing rights under the Financial Management 29 and Accountability Act 1997. 30 (2) If the Portfolio Statements indicate that activities of a particular 31 kind were intended to be treated as activities in respect of a 32 particular outcome, then expenditure for the purpose of carrying Appropriation Bill (No. 4) 2009-2010 No. , 2009 5 [Page Break] Section 9 1 out those activities is taken to be expenditure for the purpose of 2 contributing to achieving the outcome. 3 9 Administered assets and liabilities items 4 (1) The amount specified in an administered assets and liabilities item 5 for an Agency may be applied for expenditure for the purpose of 6 contributing to achieving any outcome specified for the Agency: 7 (a) in Schedule 2 to this Act; or 8 (b) in Schedule 1 to the Appropriation Act (No. 3) 2009-2010; or 9 (c) in Schedule 1 to the Appropriation (Water Entitlements) Act 10 2009-2010; or 11 (d) in Schedule 1 to the Appropriation (Water Entitlements and 12 Home Insulation) Act 2009-2010; or 13 (e) in Schedule 2 to the Appropriation Act (No. 2) 2009-2010; or 14 (f) in Schedule 1 to the Appropriation Act (No. 1) 2009-2010. 15 Note: The Finance Minister manages the expenditure of public money 16 through the issue of drawing rights under the Financial Management 17 and Accountability Act 1997. 18 (2) If the Portfolio Statements indicate that activities of a particular 19 kind were intended to be treated as activities in respect of a 20 particular outcome, then expenditure for the purpose of carrying 21 out those activities is taken to be expenditure for the purpose of 22 contributing to achieving the outcome. 23 10 Other departmental items 24 The amount specified in an other departmental item for an Agency 25 may be applied for the departmental expenditure of the Agency. 26 Note: The Finance Minister manages the expenditure of public money 27 through the issue of drawing rights under the Financial Management 28 and Accountability Act 1997. 29 11 CAC Act body payment items 30 (1) The amount specified in a CAC Act body payment item for a CAC 31 Act body may be paid to the body to be applied for the purposes of 32 the body. 6 Appropriation Bill (No. 4) 2009-2010 No. , 2009 [Page Break] Section 11 1 Note: The Finance Minister manages the expenditure of public money 2 through the issue of drawing rights under the Financial Management 3 and Accountability Act 1997. 4 (2) If: 5 (a) an Act provides that a CAC Act body must be paid amounts 6 that are appropriated by the Parliament for the purposes of 7 the body; and 8 (b) Schedule 2 contains a CAC Act body payment item for that 9 body; 10 then the body must be paid the full amount specified in the item. 11 Appropriation Bill (No. 4) 2009-2010 No. , 2009 7 [Page Break] Section 12 1 Part 3--Adjusting appropriation items 2 3 12 Reducing State, ACT, NT and local government items and 4 administered items 5 (1) If: 6 (a) an annual report for an Agency for the current year is tabled 7 in the Parliament; and 8 (b) the report specifies the amount required by an Agency in 9 respect of: 10 (i) a State, ACT, NT and local government item for the 11 Agency; or 12 (ii) an administered item for the Agency; and 13 (c) the required amount is less than the amount of the item; 14 the item is taken to be reduced to the required amount. 15 (2) The Finance Minister may, by writing, determine that 16 subsection (1): 17 (a) does not apply in relation to the item; or 18 (b) applies as if the amount specified in the annual report were 19 the amount specified in the determination. 20 (3) A determination made under subsection (2) is a legislative 21 instrument and, despite subsection 44(2) of the Legislative 22 Instruments Act 2003, section 42 (disallowance) of that Act applies 23 to the determination. However, Part 6 (sunsetting) of that Act does 24 not apply to the determination. 25 13 Reducing administered assets and liabilities items and other 26 departmental items 27 (1) A written request to reduce an administered assets and liabilities 28 item or an other departmental item for an Agency may be made to 29 the Finance Minister by: 30 (a) the Minister who is responsible for the Agency; or 31 (b) if the Finance Minister is responsible for the Agency--the 32 Chief Executive of the Agency. 8 Appropriation Bill (No. 4) 2009-2010 No. , 2009 [Page Break] Section 14 1 (2) If a request is made under subsection (1), the Finance Minister 2 may, by writing, determine that the item is to be reduced by the 3 amount specified in the request. 4 (3) However, the determination has no effect to the extent that it would 5 reduce the item below nil, after subtracting amounts that have been 6 applied under Part 2 in respect of the item. 7 (4) The item is taken to be reduced in accordance with the 8 determination. 9 (5) A request made under subsection (1) is not a legislative instrument. 10 (6) A determination made under subsection (2) is a legislative 11 instrument and, despite subsection 44(2) of the Legislative 12 Instruments Act 2003, section 42 (disallowance) of that Act applies 13 to the determination. However, Part 6 (sunsetting) of that Act does 14 not apply to the determination. 15 14 Reducing CAC Act body payment items 16 (1) A written request to reduce a CAC Act body payment item for a 17 CAC Act body may be made to the Finance Minister by: 18 (a) the Minister who is responsible for the body; or 19 (b) if the Finance Minister is responsible for the body--the 20 Secretary of the Department. 21 Note: For Department, see subsection 19A(3) of the Acts Interpretation Act 22 1901. 23 (2) If a request is made under subsection (1), the Finance Minister 24 may, by writing, determine that the item is to be reduced by the 25 amount specified in the request. 26 (3) However, the determination has no effect to the extent that it would 27 reduce the item below nil, after subtracting amounts that have been 28 paid to the body in respect of the item. 29 (4) The item is taken to be reduced in accordance with the 30 determination. 31 (5) Subsection 11(2) does not limit the reduction of a CAC Act body 32 payment item under this section. Appropriation Bill (No. 4) 2009-2010 No. , 2009 9 [Page Break] Section 15 1 (6) A request made under subsection (1) is not a legislative instrument. 2 (7) A determination made under subsection (2) is a legislative 3 instrument and, despite subsection 44(2) of the Legislative 4 Instruments Act 2003, section 42 (disallowance) of that Act applies 5 to the determination. However, Part 6 (sunsetting) of that Act does 6 not apply to the determination. 7 15 Advance to the Finance Minister 8 (1) If the Finance Minister determined an amount under subsection 9 15(2) of the Appropriation Act (No. 2) 2009-2010 before the 10 commencement of this Act, the amount is to be disregarded for the 11 purposes of subsection 15(3) of that Act. 12 Note: This means that, after the commencement of this Act, the Finance 13 Minister has access to $380 million under section 15 of the 14 Appropriation Act (No. 2) 2009-2010, regardless of amounts that have 15 already been determined under that section. 16 (2) If: 17 (a) this Act appropriates an amount for particular expenditure; 18 and 19 (b) before the commencement of this Act, the Finance Minister 20 determines an amount (the advanced amount) under 21 section 15 of the Appropriation Act (No. 2) 2009-2010 for the 22 expenditure; 23 the amount appropriated by this Act for the expenditure is taken to 24 be reduced (but not below nil) by the advanced amount. 25 10 Appropriation Bill (No. 4) 2009-2010 No. , 2009 [Page Break] Section 16 1 Part 4--General drawing rights limits 2 3 16 General drawing rights limits 4 Education Investment Fund 5 (1) On and after the commencement of this Act, subsection 16(2) of 6 the Appropriation Act (No. 2) 2009-2010 has effect as if the 7 general drawing rights limit specified in that subsection were 8 $1,311,694,000. 9 Note: This decreases the Education Investment Fund general drawing rights 10 limit for the current year by $78,400,000. 11 Health and Hospitals Fund 12 (2) On and after the commencement of this Act, subsection 16(3) of 13 the Appropriation Act (No. 2) 2009-2010 has effect as if the 14 general drawing rights limit specified in that subsection were 15 $466,700,000. 16 Note: This increases the Health and Hospitals Fund general drawing rights 17 limit for the current year by $1,000,000. 18 17 Adjustments for GST 19 If: 20 (a) a payment in respect of an acquisition or importation is or 21 was made in reliance on a general drawing rights limit 22 specified: 23 (i) in section 16 of the Appropriation Act (No. 2) 24 2009-2010; or 25 (ii) by the Finance Minister under paragraph 109(1)(a), 26 199(1)(a) or 267(1)(a) of the Nation-building Funds Act 27 2008; and 28 (b) a GST qualifying amount has arisen or does arise for that 29 acquisition or importation; 30 then the general drawing rights limit is increased or is taken, at all 31 relevant times, to have been increased, as the case requires, by the 32 amount of the GST qualifying amount. 33 Appropriation Bill (No. 4) 2009-2010 No. , 2009 11 [Page Break] in previous Acts Section 18 1 Part 5--Reducing departmental and administered 2 items for Parliamentary Departments in 3 previous Acts 4 5 18 Reducing departmental and administered items for 6 Parliamentary Departments in previous Acts 7 (1) The Finance Minister may, by writing, determine that a 8 departmental item or an administered item for a Parliamentary 9 Department in a previous act is to be reduced by the amount 10 specified in the determination. 11 (2) However, the determination has no effect: 12 (a) to the extent that it would reduce the item below nil, after 13 subtracting amounts that have been applied, under that Act, 14 in respect of the item; or 15 (b) to the extent that the amount specified, when added to any 16 other amounts specified in relation to the Parliamentary 17 Department under subsection (1), exceeds the depreciation 18 and make good amount for the Parliamentary Department. 19 (3) The item is taken to be reduced in accordance with the 20 determination. 21 (4) The determination is a legislative instrument and, despite 22 subsection 44(2) of the Legislative Instruments Act 2003, 23 section 42 (disallowance) of that Act applies to the determination. 24 However, Part 6 (sunsetting) of that Act does not apply to the 25 determination. 26 (5) Despite subsection 33(3) of the Acts Interpretation Act 1901, the 27 determination must not be rescinded, revoked, amended or varied. 28 (6) In this section: 29 administered item, in relation to a previous Act, means an 30 administered item within the meaning of that Act. 31 departmental item, in relation to a previous Act, means a 32 departmental item within the meaning of that Act. 12 Appropriation Bill (No. 4) 2009-2010 No. , 2009 [Page Break] previous Acts Part 5 Section 18 1 depreciation and make good amount, in relation to a 2 Parliamentary Department, means the total of the amounts of 3 departmental items and administered items from all previous Acts 4 that have been identified by the Finance Minister as having been 5 provided for the following purposes, but which have not yet been 6 applied: 7 (a) meeting depreciation costs; 8 (b) meeting amortisation costs; 9 (c) meeting the costs of returning an asset to a previous state or 10 condition. 11 Parliamentary Department, in relation to a previous Act, means a 12 Parliamentary Department within the meaning of that Act. 13 previous Act means: 14 (a) the Appropriation (Parliamentary Departments) Act (No. 1) 15 2009-2010; or 16 (b) the Appropriation (Parliamentary Departments) Act (No. 1) 17 2008-2009; or 18 (c) the Appropriation (Parliamentary Departments) Act (No. 1) 19 2007-2008; or 20 (d) the Appropriation (Parliamentary Departments) Act (No. 1) 21 2006-2007; or 22 (e) the Appropriation (Parliamentary Departments) Act (No. 1) 23 2005-2006; or 24 (f) the Appropriation (Parliamentary Departments) Act (No. 2) 25 2004-2005; or 26 (g) the Appropriation (Parliamentary Departments) Act (No. 1) 27 2004-2005; or 28 (h) the Appropriation (Parliamentary Departments) Act (No. 2) 29 2003-2004; or 30 (i) the Appropriation (Parliamentary Departments) Act (No. 1) 31 2003-2004; or 32 (j) the Appropriation (Parliamentary Departments) Act (No. 1) 33 2002-2003; or 34 (k) the Appropriation (Parliamentary Departments) Act (No. 2) 35 2001-2002; or Appropriation Bill (No. 4) 2009-2010 No. , 2009 13 [Page Break] in previous Acts Section 18 1 (l) the Appropriation (Parliamentary Departments) Act (No. 1) 2 2001-2002; or 3 (m) the Appropriation (Parliamentary Departments) Act (No. 2) 4 2000-2001; or 5 (n) the Appropriation (Parliamentary Departments) Act (No. 1) 6 2000-2001; or 7 (o) the Appropriation (Parliamentary Departments) Act 8 1999-2000. 9 14 Appropriation Bill (No. 4) 2009-2010 No. , 2009 [Page Break] Section 19 1 Part 6--Miscellaneous 2 3 19 Crediting amounts to Special Accounts 4 If any of the purposes of a Special Account is a purpose that is 5 covered by an item (whether or not the item expressly refers to the 6 Special Account), then amounts may be debited against the 7 appropriation for that item and credited to that Special Account. 8 20 Conditions etc. applying to State, ACT, NT and local government 9 items 10 (1) This section applies to any payment made out of money 11 appropriated by a State, ACT, NT and local government item for 12 an outcome specified in column 2 of the table in Schedule 1. 13 (2) The payment: 14 (a) must be made on the terms and conditions (if any) from time 15 to time determined, in the way described in subsection (3), as 16 applying to payments made: 17 (i) in relation to the outcome; and 18 (ii) to or for a State, the Australian Capital Territory, the 19 Northern Territory or a local government authority; and 20 (iii) out of money appropriated by an annual Appropriation 21 Act; and 22 (b) must be made in accordance with any determination in 23 writing made by the Minister specified, in column 4 of the 24 table in Schedule 1, for the outcome as to amounts and times 25 of payments. 26 (3) The way of determining the terms and conditions applying to 27 payments described in paragraph (2)(a) is for the Minister 28 specified, in column 3 of the table in Schedule 1, for the outcome 29 to make the determination in writing before or after the 30 commencement of this Act. 31 (4) Determinations mentioned in paragraph (2)(a) and determinations 32 made under paragraph (2)(b) are not legislative instruments.
