A Bill for an Act to amend the Administrative Appeals
Tribunal Act 1975, and for related purposes
The Parliament of Australia enacts:
This Act may be cited as the Administrative Appeals Tribunal Amendment
(Review of Decisions) Act 2004.
This Act commences on the day on which it receives the Royal
Assent.
The Administrative Appeals Tribunal Act 1975 is amended as set out
in Schedule 1.
1 Subsection 27(1)
Repeal the subsection, substitute:
(1) Where this Act or any other enactment (other than the Australian
Security Intelligence Organisation Act 1979) provides that an application
may be made to the Tribunal for a review of a decision, the application may be
made:
(a) by or on behalf of any person or persons (including the Commonwealth
or an authority of the Commonwealth) whose interests are affected by the
decision; or
(b) by a member of Parliament.
2 After subsection 27(1)
Insert:
(1A) For the purposes of paragraph (1)(b):
member of Parliament means a member of:
(a) the Parliament of the Commonwealth: or
(b) the Parliament of a State; or
(c) the Legislative Assembly of the Northern Territory; or
(d) the Legislative Assembly for the Australian Capital
Territory.
