     The Parliament of Australia enacts:
 5


     1 Short title
 6

                 This Act may be cited as the ABC Amendment (Online and
 7
                 Multichannelling Services) Act 2001.
 8


     2 Commencement
 9

                 This Act commences on the day on which it receives the Royal
10
                 Assent.

               Each Act that is specified in a Schedule to this Act is amended or
2
               repealed as set out in the applicable items in the Schedule
3
               concerned, and any other item in a Schedule to this Act has effect
4
               according to its terms.

     Schedule 1--Amendment of the Australian

           Broadcasting Corporation Act 1983

     1 Subsection 3(1)
 4

           Insert:
 5

                 multichannelled broadcasting service, in relation to a national
 6
                 broadcasting service, has the meaning given by clause 5A of
 7
                 Schedule 4 of the Broadcasting Services Act 1992.
 8


     2 After section 6A
 9

           Insert:

     6B Online and multichannelling services
11

                 For the purposes of the performance of its functions, the
12
                 Corporation must provide:
13
                  (a) multichannelled broadcasting services; and
14
                  (b) online services by either or both of the following means:
15
                         (i) the Internet;
16
                        (ii) electronic transmission over a path or combination of
17
                             paths.

     3 After subsection 31(1)

           Insert:
20

          (1A) Subsection (1) applies to the Corporation's online services.
21

          (1B) Without limiting subsection (1A), the Corporation must not
22
               provide or permit electronic links between its online services and
23
               any other online service which promotes a commercial body,
24
               product or service.
25

          (1C) In providing or permitting electronic links between the
26
               Corporation's online services and any other online service, the
27
               Corporation must ensure that the link includes a warning that the
28
               user is leaving the Corporation's services.
