Australian Capital Territory Repealed ActsThis legislation has been repealed.
NOTES
1. The Inebriates Act, 1900 of the State of New South Wales (No. 32, 1900) as amended before 1 January 1911 by the Inebriates (Amendment) Act, 1909 (see Note 2) was one of the laws in force in the Australian Capital Territory before 1 January 1911 and was therefore continued in force by the Seat of Government Acceptance Act 1909 of the Commonwealth.
The Inebriates Act, 1900 of the State of New South Wales in its application in the Territory has been amended since 1 January 1911 by the Inebriates Ordinance 1938 as amended (a) for details of those amendments see the Table of Amendments to this reprint.
The Inebriates Act, 1900 of the State of New South Wales has been further amended as indicated in the Tables below.
Citation of Laws—The Self-Government (Citation of Laws) Act 1989 (No. 21, 1989) altered the citation of most Ordinances so that after Self-Government day they are to be cited as Acts. That Act also affects references in ACT laws to Commonwealth Acts.
2. The Legislation (Republication) Act 1996 (No. 51, 1996) authorises the Parliamentary Counsel in preparing a law for republication, to make certain editorial and other formal amendments in accordance with current legislative drafting practice. Those amendments make no change in the law. Amendments made pursuant to that Act do not appear in the Table of Amendments but details may be obtained on request from the Parliamentary Counsel's Office.

(a) Subsections 3 (2) and (3) of the Mental Health Act 1983 provide as follows:
“(2) The Inebriates Act, 1900 of the State of New South Wales and the Inebriates (Amendment) Act, 1909 of that State shall cease to be in force in the Territory.
“(3) The Inebriates Ordinance 1938 is repealed.”
Subsection 2 (2) of the Mental Health Act 1983 provides as follows:
“(2) The remaining provisions of this Act shall come into operation on such date as is fixed, or on such respective dates as are fixed, by the Minister of State for Territories and Local Government by notice in the Gazette.”
As at 9 December 1998 no date had been fixed for the commencement of subsections 3 (2) and (3) and consequently the repeals are not effective.

3. S. 10—Section 7 of the Inebriates Act, 1909 of the State of New South Wales provides as follows:
“7. Section ten of the Principal Act is amended by inserting after “an order under,” wherever that expression occurs, the words “section one.”
