EMERGENCY MANAGEMENT ACT 1999 (REPEALED) - SECT 29

    (1)     Where the controller believes on reasonable grounds that a person is obstructing or threatening to obstruct response or recovery operations during an emergency period, the controller may remove the person to such a place as he or she thinks proper.

    (2)     In exercising his or her powers under subsection (1), the controller may use such force as is necessary and reasonable in the circumstances.

    (3)     Subsection (1) shall not be taken to authorise the detention of a person except for the purpose of the removal.
