DISTRICTS ACT 1966 NO 5 (REPEALED) - SECT 7

Deposited plans

    (1)     For this Act, the Minister shall cause a plan to be prepared setting out the boundaries of, and the distinguishing number or name given by the Minister to, each division, section or block that is formed by deposited plan under this Act.

    (2)     A plan so prepared shall be presented for lodging at the office of the registrar-general.

    (3)     The registrar-general shall not accept a plan in respect of land the description of which includes a reference to a "district", division, section or block for lodging as a deposited plan unless the commissioner for surveys has certified on the plan to the effect that the plan has been prepared under this Act and that the land is correctly so described.

    (4)     The registrar-general shall endorse or cause to be endorsed on each plan accepted for lodging the time and date of lodging, the words ‘deposited plan' and a consecutive number in order of lodging.

    (5)     The registrar-general shall sign a plan that is accepted for lodging and endorsed as provided by this section, or cause to be attached to the plan a stamp that is a facsimile of his or her signature, and the plan thereupon becomes a deposited plan.

    (6)     If the Minister, by an amending deposited plan, alters the boundaries or the number or name of a division, section or block, the registrar-general shall endorse or cause to be endorsed on the deposited plan affected by the alteration a note to the effect that the plan has been amended by the specified amending deposited plan on the date of the lodging of the amending deposited plan under this Act.

    (7)     A deposited plan is, unless the contrary is proved, evidence of the measurements and boundaries of the areas of land shown on it.
