SURVEYORS (AMENDMENT) ACT 1992 (No 1 of 1992) - TABLE OF PROVISIONS 1. This Act may be cited as the Surveyors (Amendment) Act 1992. 2. (1) Sections 1, 2 and 3 commence on the day on which this Act is notified in the Gazette. 3. In this Act, "Principal Act" means the Surveyors Act 1967.1 4. After section 5 of the Principal Act the following section is inserted: 5. Section 6 of the Principal Act is amended by omitting from subsections (1) and (2) "Commonwealth Surveyor-General" and substituting "Chief Surveyor". 6. Section 51A of the Principal Act is amended by omitting from subsections (1) and (3) "Surveyor-General" (wherever occurring) and substituting "Chief Surveyor". SURVEYORS (AMENDMENT) ACT 1992 - LONG TITLE An Act to amend the Surveyors Act 1967 Short title SURVEYORS (AMENDMENT) ACT 1992 - SECT 1 1. This Act may be cited as the Surveyors (Amendment) Act 1992. Commencement SURVEYORS (AMENDMENT) ACT 1992 - SECT 2 2. (1) Sections 1, 2 and 3 commence on the day on which this Act is notified in the Gazette. (2) The remaining provisions commence on a day fixed by the Minister by notice in the Gazette. (3) If a provision referred to in subsection (2) has not commenced before the end of the period of 6 months commencing on the day on which this Act is notified in the Gazette, that provision, by force of this subsection, commences on the first day after the end of that period. Principal Act SURVEYORS (AMENDMENT) ACT 1992 - SECT 3 3. In this Act, "Principal Act" means the Surveyors Act 1967.1 Insertion SURVEYORS (AMENDMENT) ACT 1992 - SECT 4 4. After section 5 of the Principal Act the following section is inserted: Chief Surveyor "5A. (1) The Minister may, by instrument, appoint a person to be the Chief Surveyor. "(2) The Minister may, by instrument, appoint a person to act as Chief Surveyor-- (a) during a vacancy in the office of Chief Surveyor, whether or not an appointment has previously been made to the office; or (b) during any period, or during all periods, when the Chief Surveyor is absent from duty or from the Territory or is, for any other reason, unable to perform the functions of that office; but a person appointed to act during a vacancy shall not continue so to act for more than 12 months. "(3) A person may not be appointed under subsection (1) or (2) unless he or she-- (a) is a public servant; and (b) is entitled to be registered under Part III.".
