CANBERRA INSTITUTE OF TECHNOLOGY (No 11 of 1997) - TABLE OF PROVISIONS 1. This Act may be cited as the Canberra Institute of Technology (Amendment) Act 1997. 3. In this Act, "Principal Act" means the Canberra Institute of Technology Act 1987.1 4. Section 14 of the Principal Act is amended by adding at the end the following subsection: 5. Sections 19, 20, 21 and 22 of the Principal Act are repealed and the following section substituted: CANBERRA INSTITUTE OF TECHNOLOGY - LONG TITLE An Act to amend the Canberra Institute of Technology Act 1987 Short title CANBERRA INSTITUTE OF TECHNOLOGY - SECT 1 1. This Act may be cited as the Canberra Institute of Technology (Amendment) Act 1997. Commencement 2. (1) Sections 1, 2 and 3 commence on the day on which this Act is notified in the Gazette. (2) The remaining provisions commence on a day, or respective days, fixed by the Minister by notice in the Gazette. (3) If a provision referred to in subsection (2) has not commenced before the end of the period of 6 months commencing on the day on which this Act is notified in the Gazette, that provision, by force of this subsection, commences on the first day after the end of that period. Principal Act CANBERRA INSTITUTE OF TECHNOLOGY - SECT 3 3. In this Act, "Principal Act" means the Canberra Institute of Technology Act 1987.1 Director CANBERRA INSTITUTE OF TECHNOLOGY - SECT 4 4. Section 14 of the Principal Act is amended by adding at the end the following subsection: "(5) A determination under subsection (4) shall not include a term or condition that could not be applicable to an Executive employed under section 72 of the Public Sector Management Act 1994.". Substitution CANBERRA INSTITUTE OF TECHNOLOGY - SECT 5 5. Sections 19, 20, 21 and 22 of the Principal Act are repealed and the following section substituted: Acting Director "22. (1) Subject to this section, the Minister may, in writing, appoint a person to act as Director-- (a) during a vacancy in the office of Director, whether or not an appointment has previously been made to the office; or (b) during any period, or during all periods, when the Director is for any reason unable to perform the functions of the office; on such terms and conditions as are determined by the Minister in writing. "(2) A person appointed to act as the Director during a vacancy in the office of Director shall not so act continuously for more than 12 months. "(3) A determination under subsection (1) shall not include a term or condition that could not be applicable to an Executive employed under section 72 of the Public Sector Management Act 1994. "(4) Anything done by or in relation to a person purporting to act pursuant to an appointment under subsection (1) is not invalid on the ground that-- (a) the appointment was ineffective or had ceased to have effect; or (b) the occasion to act had not arisen or had ceased.".
