CHILDREN AND YOUNG PEOPLE ACT 1999 (NO. 63 OF 1999) - SECT 434
Declarations made immediately before commencement day(1) A declaration made under section 80 (Hearing and determination of application) of the repealed Act in relation to a child in relation to which no order under that section had been made before the commencement day, is taken to be a declaration under subsection 255 (1) (Final care and protection orders) of this Act.
(2) If, before the commencement day, a child was referred to the Mental Health Tribunal under section 83A (Referral to the Mental Health Tribunal) of the repealed Act, but no order had been made in relation to the child as a result of the referral before the commencement day, on and after the commencement day the referral is taken to have been made under section 255 of this Act.
