WORKERS COMPENSATION REGULATION 2002 - REG 99
Court approved termination(1) This section applies if an insurer intends to apply to the Magistrates Court under the
title="Workers Compensation Act 1951">Act, section 132 (Rejecting claims from 1 year) for leave to end payments of weekly compensation to a worker.
Note An insurer must apply to the Magistrates Court if the insurer wants to end payments of compensation 1 year or longer after the claim is made (see
title="Workers Compensation Act 1951">Act, s 132).
(2) The insurer must give the worker notice of the insurer's intention to apply to the Magistrates Court for leave.
(3) The insurer must give a copy of a notice under subsection (2) to the DI fund manager as soon as practicable.
Maximum penalty: 5 penalty units.
(4) An offence against this section is a strict liability offence.
(5) If the Magistrates Court is satisfied that the worker is not entitled to receive weekly compensation, the court must give leave to the insurer to end payment of the compensation to the worker after a stated day that is at least 8 weeks after the day the insurer gave the worker notice under subsection (2).
