MEDICINES, POISONS AND THERAPEUTIC GOODS REGULATION 2008 - REG 545

Prescribed witnesses for discarding of controlled medicines—Act, s 54 (a) and (b)

    (1)     The following people are prescribed as witnesses in relation to the discarding of a controlled medicine:

        (a)     an ambulance officer employed by the Commonwealth, the Territory or a State;

        (b)     an approved analyst;

        (c)     a dentist;

        (d)     a doctor;

        (e)     a medicines and poisons inspector;

        (f)     a midwife;

        (g)     a nurse;

        (h)     a nurse practitioner;

              (i)     a pharmacist;

        (j)     a veterinary surgeon.

Note 1     Approved analyst —see the dictionary.

Note 2     Dentist , doctor , "pharmacist" and veterinary surgeon does not include an intern or trainee (see defs of these terms in dict).

Note 3     Nurse does not include an enrolled nurse (see Legislation Act, dict, pt 1).

Note 4     See s 390 for the discarding of the residue of a controlled medicine left after administration.

    (2)     However, a person mentioned in subsection (1) must not be a prescribed witness to the discarding of a controlled medicine if the person is—

        (a)     related to, a close friend of or employed by the person discarding the medicine; or

        (b)     the supervisor of the person discarding the medicine; or

        (c)     supervised by the person discarding the medicine.
