THE LAW SOCIETY OF THE AUSTRALIAN CAPITAL TERRITORY

Practitioner Acting for Both Lessor and Lessee


Instructions to Practitioner



The Law Society of the Australian Capital Territory is not in favour of the practice of one practitioner or firm of practitioners acting for both lessor and lessee in any transaction for the reason that a practitioner or firm of practitioners cannot, in the opinion of the Society, properly fulfil their duty to both parties in circumstances where a conflict between the parties may arise.

The Society recognises, however, that occasions do arise when a lessor and lessee desire to employ the same practitioner or firm of practitioners and it does not object provided the fact that the practitioner proposes to accept instructions to act for both parties is drawn to the attention of each party.

I have read the above I, hereby instruct to act for me in the matter specified below acknowledging that the *practitioner/*firm of practitioners will also be acting for the *lessor/*lessee in the same transaction.
