DANGEROUS SUBSTANCES (EXPLOSIVES) REGULATION 2004 - REG 264

    (1)     A person commits an offence if the person—

        (a)     uses a controlled firework; and

        (b)     is not authorised by a licence or otherwise under the Act to use the firework.

Maximum penalty: 30 penalty units.

Note     A reference to an Act includes a reference to the statutory instruments made or in force under the Act, including any regulation (see Legislation Act, s 104).

    (2)     An offence against this section is a strict liability offence.
