TREE PROTECTION ACT 2005 - SECT 39

    (1)     The Minister may, in writing, declare a stated area of land in a built-up urban area to be a tree management precinct.

    (2)     The Minister may declare an area of land in a built-up urban area to be a tree management precinct only if satisfied that the area satisfies the criteria determined under section 38.

    (3)     A declaration is a notifiable instrument.

Note     A notifiable instrument must be notified under the Legislation Act.
