Australian Capital Territory Consolidated Acts Australian Capital Territory Consolidated Acts(1) The holder of a retail tobacconist's licence commits an offence if the holder obtains a smoking product from someone who is not the holder of a wholesale tobacco merchant's licence.
Maximum penalty: 50 penalty units.
(2) An offence against this section is a strict liability offence.
(3) It is a defence to a prosecution for an offence against subsection (1) if the defendant proves that the defendant obtained the smoking product for a purpose other than retail sale.
