SALE OF MOTOR VEHICLES ACT 1977 - SECT 60

Certain persons may apply for compensation

    (1)     A person, other than a trade owner, who suffers financial loss in connection with a motor vehicle because of the failure of a licensed dealer to comply with an obligation imposed on him or her by this Act or because of the failure of a licensed dealer to pass an unencumbered title to the vehicle may apply to the registrar for compensation under this part in relation to that loss.

    (2)     An application for compensation under this part shall be made by giving the registrar particulars of the claim supported by a statutory declaration.

    (3)     An application for compensation under this part shall not be accepted by the registrar unless it is made within a period of 6 months after the applicant becomes aware of the loss or within the further time (if any) that the registrar, either before or after the end of that period, allows.
