SECURITY INDUSTRY ACT 2003 - SECT 43

Licensee not to dispose of licence etc

    (1)     A licensee commits an offence if the licensee—

        (a)     gives the licence, temporarily or permanently, to anyone; or

        (b)     allows anyone else to use the licence.

Maximum penalty: 50 penalty units, imprisonment for 6 months or both.

    (2)     An offence against this section is a strict liability offence.

    (3)     This section does not apply if the licensee gives the licence to the commissioner for fair trading.
