Australian Capital Territory Consolidated ActsIf, in relation to a public interest disclosure that he or she has received, the ombudsman or the auditor-general considers—
(a) that there is no other proper authority that can adequately or properly act on the disclosure; or
(b) that any proper authority that should have acted on the disclosure has failed, or been unable for any reason, to adequately act on the disclosure;
the ombudsman or the auditor-general may exercise his or her powers to act on
the disclosure.
