Australian Capital Territory Consolidated Acts(1) A person shall not sell or export from the Territory a protected native plant, or a plant that has special protection status, other than a seed or a dead plant, unless there is attached to the plant a tag of an approved kind on which the particulars referred to in subsection (2) are clearly and indelibly marked.
Maximum penalty:
(a) if the plant has special protection status—50 penalty units; or
(b) in any other case—25 penalty units.
(2) The particulars to be marked on a tag for the purpose of subsection (1) are—
(a) the name of the person proposing to sell or export the plant; and
(b) the botanical name and common name (if any) of the plant.
(3) For the purposes of subsection (1), a tag
shall be taken to be a tag of an approved kind if it is made of metal,
plastic, cloth or some other durable material.
