Australian Capital Territory Consolidated Acts(1) Nothing in section 72 or 74 permits the ACAT to require a person to remain in custody for a period that is, or for periods that in the aggregate are, greater than the limiting period.
(2) In subsection (1):
"limiting period", in relation to a person, means a period that is equivalent to the period—
(a) commencing on the day on which an order of the relevant court under the Crimes Act, part 13 is made requiring the person to be detained in custody until the ACAT orders otherwise; and
(b) ending on the day on which, if
the person had been sentenced to a term of imprisonment for a period
equivalent to the term nominated under that Act, section 301, section 302,
section 304 or section 305 (as the case may be) that sentence would have
expired.
