Australian Capital Territory Consolidated ActsIf—
(a) the plaintiff in an action against a magistrate is entitled to recover, and seeks to recover a penalty or other amount paid or raised as a result of a conviction, judgment or order or to recover damages for imprisonment; and
(b) it is proved that the plaintiff was guilty of the offence or liable to pay the amount or, for imprisonment, did not undergo any greater punishment than could have been imposed for the offence of which the plaintiff was convicted;
the plaintiff is not entitled to recover the penalty or other amount paid or
raised or, for imprisonment, damages greater than 1 cent, or any costs in
the action.
