MAGISTRATES COURT ACT 1930 - SECT 114

If defendant does not admit the case

    (1)     This section applies if the defendant does not admit the truth of the information.

    (2)     The court must hear—

        (a)     the informant and the informant's witnesses (if any); and

        (b)     if the defendant wants to give evidence—the defendant; and

        (c)     the defendant's witnesses (if any); and

        (d)     if the defendant has given evidence other than about the defendant's general character—the informant's witnesses in reply (if any).

    (3)     Having heard each party and the evidence, the court must decide the information and do 1 of the following as justice requires:

        (a)     convict the defendant;

        (b)     make an order on the defendant;

        (c)     dismiss the information.
