LEGISLATION ACT 2001 - SECT 78

Separate commencement of amendments

    (1)     Amendments made by a provision of a law may be given separate commencements, whether or not the provision is self-contained.

Examples

1     A provision of an amending law inserts 2 sections. The sections may be given separate commencements.

2     A provision of an amending law inserts a section that is divided into paragraphs. The paragraphs may be given separate commencements.

Note     An example is part of the Act, is not exhaustive and may extend, but does not limit, the meaning of the provision in which it appears (see s 126 and s 132).

    (2)     This section is a determinative provision.

Note     See s 5 for the meaning of determinative provisions, and s 6 for their displacement.
